- A copy of the Status Options Review carried out in 2008.
- A copy of the associated briefing document written by your Commercial Director, James Froomberg.
- The total charges made by KPMG in regard to this report.

In response to your request please find attached a copy of the Status Options Review dated June 2008 and a copy of the Press Release titled 'Waterways for the 21st Century' which details the cost of this report. Please note that there is no associated briefing document by James Froomberg.

In short, I asked you to provide the two items of information omitted from your first response and carry out a review to determine why they were not provided.

Instead, you have sent me another document I did not ask for!

You say "No briefing document written by Commercial Director James Froomberg exists".

For the avoidance of doubt, I am asking for the briefing document produced by James Froomberg in mid 2007 and published on British Waterways website together with the KPMG report. From memory, I believe that report was titled "British Waterways Strategic Options Review" (or similar) and was an briefing document and invitation to tender for consultancy services in connection with the review.

I also recall that you published a list of those invited to tender (but I have not requested that).

May I ask that you delay no further, stop sending me information not requested, provide me with the information to which I am entitled and carry out the review.

Please accept my apologies for the delay responding to you, it took a little time to locate the document you requested.

We did not recognise that this was the document you referred to from your original request for a copy of the 'briefing document' however, the information in your e-mail of 15th November aided our search.

I now attach a copy of the 'BW Strategic Operations Review May 2007', a document produced by James Froomberg for consultants who were invited to bid for the review work.

Dear Mr Richards,

You are now in receipt of both pieces of information requested. The first ' The total charges made by KPMG in regard to this report' was provided in my initial response, sent on 8th November. This information is contained within the Press Release titled 'Waterways for the 21st Century'. Another copy is attached for you now.

The second piece of information has been supplied to you following your clarification of the document you had requested. You originally referred to an 'associated briefing document written by your Commercial Director, James Froomberg'. We were aware that James Froomberg was no longer with British Waterways at the time the KPMG report was published and could therefore not possibly have written an associated briefing document. That is why the report to the board written by Nigel Johnson was sent following our original response.

It was only upon your clarification that the document you referred to actually pre-dated the KPMG report, was an invitation to tender and was published in 2007 that we were able to locate a copy from the old website server archive. The title of the document was also very helpful information, even though it was not quite correct. This document was supplied to you as soon as it was located. Furthermore, had you provided us with this this detail about the document when you first made your request you would have received a copy much sooner and avoided any confusion.
