Status of the National Police Chiefs Council in relation to the Freedom of Information Act

Dear National Police Chiefs Council,

Could you please release any information held on the status of the National Police Chiefs' Council with respect to the Freedom of Information Act.

I am interested in if the National Police Chiefs' Council currently considers itsself to be subject to the Freedom of Information Act, and if so, on what basis; and in any proposals for designating the National Police Chiefs' Council as a public body for the purposes of the Freedom of Information Act.

I expect the National Police Chiefs' Council may hold material on this subject which can be released. If the Secretary of State has consulted the National Police Chiefs' Council on designating the body under the Freedom of Information Act I would like the correspondence relating to that to be released as part of the response to this request.

I am only seeking current information; and not any historical material on this subject. I am not requesting ACPO press releases covering this subject or evidence provided orally or in writing to the Home Affairs Select Committee.

It appears three years after the organisation was established the National Police Chief's Council is still not formally subject to the Freedom of Information Act.

The Information Commissioner has placed a notice on its website stating:

"If your concern is regarding the National Police Chief’s Council (NPCC), (the replacement body to the Association of Chief Police Officers), please note the NPCC is not currently a public authority for the purposes of the Freedom of Information Act 2000 (FOIA). This means the ICO has no jurisdiction to issue a decision notice in relation to information requests made to the NPCC.

The ICO has been told the necessary legislative order to make the NPCC accountable under FOIA is expected to be made shortly. However, until this happens, we are unable to process any concerns relating to disclosure of information by the NPCC."
