I am making this request under the Freedom of Information Act.

I would like to request UK HSE statistics on the number of prohibition and improvement notices issued to top and lower-tier COMAH sites relating to failings found in Functional Safety compliance (BS EN 61508 / 11) and Safety Instrumented Systems.

Your request was received on 14 September 2018 and I am dealing with it
under the terms of the Freedom of Information Act 2000 (the Act).

 

I am writing to advise you that HSE does not record this information as
specific ‘tick box’. Records of this type are only identifiable by
searching a free text summary of the Enforcement Notice using ‘keywords’.

 

Using keywords taken from your request we find 18 Enforcement Notices have
been issued, 17 Improvement and 1 Prohibition. 5 at Lower Tier and 13 at
Upper Tier COMAH Establishments. The one indicated Prohibition Notice
occurred at a Lower Tier establishment.
