Pursuant to the Freedom of Information Act 2000 and/or the Environmental Information Regulations 2004 and/or the Local Government (Northern Ireland) Order 2005 we hereby request the following information to be made available within 20 working days.

All correspondence, documentation and records (including minutes of meetings, memos, spread sheets and such like) relating to contracts between Northern Ireland Transport Holding Company, or Translink, and third parties that have been terminated and/or ended early by either party. Specifically:

• The name of the third party;
• The value of the contract;
• The subject matter of the contract; and
• The reason for termination.

Dear Ms. Barry,

 

Further to my earlier, brief acknowledgement I am now in a position to
respond to your request under the Freedom of Information Act 2000.

 

Unfortunately, we are unable to match your request with the information
you are seeking.  Whilst this letter should be taken as a refusal notice,
we are keen for you to be made aware of our reasons for not responding as
you would like.  There are particular sensitivities at the centre of your
request which we hope you will appreciate. 

 

Translink has relied on the exemption contained in Section 31 of The
Freedom of Information Act.  This is because disclosure would be likely to
prejudice:-

 

s.31 a) the prevention or detection of crime;

 

s.31 b) the apprehension or detection of offenders;

 

s.31 c) the administration of justice;

 

s. 31 (2) (a) ascertaining if someone has failed to comply with the law.

 

Translink has considered the public interest test when relying on this
exemption.  In doing so, Translink considers that the public interest in
maintaining the exemption outweighs the public interest in disclosure. 
The factors considered are:-

 

o The public interest to safeguard the investigatory process;

 

o An individual’s right of access weighed against the potential to
undermine an investigation; and

 

o The effect upon possible enforcement processes.

 

We understand that you may not be satisfied with this response, in which
case you may request a review by writing to the Translink Director of
Human Resources & Organisational Development, who has overall
responsibility for Freedom of Information and Data Protection issues
within the Northern Ireland Transport Holding Company/Translink
organisation.  Correspondence should be addressed to the above-mentioned
at: Translink, Central Station, East Bridge Street, Belfast BT1 3PB.

 

If we are then unable to resolve any complaint that you may have, you may
refer the matter to the Information Commissioner who will make an
independent judgement.  The address of the Information Commissioner is:
