Re: Information Request received on 13 January 2015. Our Ref: RFI/1168

 

I write further to your recent request for information. Please find
detailed the following information:-

 

1.    Copy of your initial request.

 

2.    The following information as per your request:

 

Special Education is not aware of any school aged pupil with statements of
special educational needs for ASD who are not registered at a school.  The
Section does not maintain records of attendance.

 

Special Education and Education Welfare are aware of a number of school
aged pupils with statements of special educational needs for ASD whose
parents have chosen to educate at home however figures present as less
than 5 and are being suppressed under Section 40(2) of the FOIA which
provides that information is exempt from disclosure if it constitutes
personal data and either the first or the second condition in section
40(3) is satisfied.  The first condition in section 40(3) states that the
disclosure of personal data would (i) contravene any of the data
protection principles, or (ii) section 10 of the Data Protection Act
1998. 

Where figures present as less than five, disclosure would be considered
unfair and would breach the first data protection principle as the
information relates to living person/s and those person/s are considered
potentially identifiable.

If you have any complaints in respect of your information request, please
submit your complaint in accordance with the Board’s Comments and
Complaints Policy which is available on the Board’s website.
