Station Plaza - Planning application HS/FA/23/00875 - failure to discharge pre-commencement conditions for HS/FA/06/00983
Dear Hastings Borough Council,
The original permission HS/FA/06/00983 had 12 pre-commencement conditions. These conditions must be discharged prior to any works commencing. There is no evidence that these conditions have been discharged. The failure to discharge these pre-commencement conditions means that the original permission is no longer valid.
The following conditions were pre-commencement and were not discharged prior to works starting:
3 Soft Landscaping; 4 hard landscaping; 7 material samples;9 site contamination survey;11 cctv location;14 boundary treatments;15 public art;16 surface and foul water drainage;21 excavation methods;22 survey on impact on neighbouring properties;23 Construction Management Plan; 25 Species assessment
There is no record on the planning website of any of these conditions having been discharged using a discharge of conditions application.
Please provide under FOI:
1. Evidence that these 12 conditions were properly discharged using discharge applications
2. The planning reference numbers for such discharge applications
3. Copies of any external correspondence with outside bodies concerning the discharge of these 12 conditions
4. Copies of any internal correspondence within HBC concerning the discharge of these 12 conditions
5. Copies of any legal advice given concerning the discharge of these 12 conditions
