standard template for PIP appeal response
Dear Department for Work and Pensions,
I would be grateful if you could advise if :
1. There are standard templates for appeal responses in the case of Personal Independence Payment (PIP) Appeals?
if so:
a) How are these standard templates drafted, distributed and updated?
b) What guidance is given for their use?
c) Do different standards exist for renewal, supersession or new claim appeals?
d) Please provide a copy of the standard template or, as the case may be, templates.
2. Are there standard paragraphs/sections habitually used in appeal responses for PIP appeals?
If so:
a) How are these drafted, distributed and updated? (or if these are integral to the template)
b) What guidance is given for their use?
C) Please provide a list of the standard paragraphs/sections and as many of the standard
paragraphs/sections as possible within financial constraints, but including the following
topics:
i) Supersession on receipt of a medical report (reg 26 UC, PIP etc. (D&A) regs 2013)
ii) Explaining reasons for preferring Healthcare Professional's report
iii) Addressing whether and/or the extent to which court and upper tribunal cases
which interpreted the law differently from the DWP but which have subsequently
been accepted as correct (including MM, RJ and MH) have been considered
