Request for Review

I am writing to request an internal review of Aintree University Hospitals
NHS Foundation Trust's handling of my FOI request 'Staffing statistics'.

It seems incredulous that, given cost implications, this information
requested is not on record?

 

The purpose of an Internal Review is to assess how your Freedom of
Information request was handled in the first instance and to determine
whether the original decision given to you was correct. This is an
independent review: I was not involved in the original decision.

Having undertaken the research independently and after careful
consideration I have concluded that the initial response that was sent to
you was, in part, not compliant with the requirements of the FOIA.

 

An explanation of my decision follows.

 

The FOI response was provided within statutory timeframe of 20 days.

 

The internal review noted that the Trust responded to the request on 03^rd
May 2018 stating the information requested was not collated.

Under FOIA 2000, the Trust is not required to create any information in
order to answer a request.

I should explain that the FOIA 2000 is to do with transparency of
information held by public authorities. It gives an individual the right
to access recorded information held by public authorities. The FOIA 2000
does not require public authorities to generate information, or to answer
questions, provide explanations or give opinions, unless this is recorded
information that they already hold.

 

I have established that although the information is not electronically
collated as specifically as you have requested, we do have the building
blocks to manually collate the data, within the permitted timeframe of 18
hours contained within Section 12 of the act..

 

As an outcome of the review I requested the HR Department to manually
collate the data and the information is now provided below:

 

1. During the calendar year 2017 what percentage of NURSING staff were
employed via agencies (aka the bank). - 5.20%

 

2. What is the difference, as a percentage, in pay between directly
employed and agency staff.

Thank you for your reply. The statistic provided are not as requested. The percentages do not give "monetary" insite as to the difference in pay scale between agency and "staff" pay , of a singular grade of nurses.

I have re-read our response to question 2 (see copy below for percentage
table). As far as I can see the data provided in the final column
(highlighted in green) answers this question i.e for a band 5 nurse the
difference is agency staff costing is 77% more. The comparison given for a
band 2 is based on a Health Care Assistant role.
