Subject: Football Stadium Safety Certificates

 

Thank you for your request for information of 08/03/2019 where you asked
the following:

 

Could you please provide details (including copies if possible please) of
the most recently granted safety certificates for all SPFL clubs within
your remit along with details of any remedial works/adverse findings from
inspections?

 

Your request has been processed under the Environmental Information
(Scotland) Regulations 2004 (EIRs). Unfortunately, the Council is only
able to meet part of your request; this information is released to you
now.

 

The most recent certificates issued are:

 

Tynecastle Park                    31 October 2018                   
General Safety Certificate

 

Easter Road Stadium           22 July 2018                          
General Safety Certificate

 

No remedial works had to be carried out before the issuing of the
certificates in either case.

 

Although copies of the certificates are held by the City of Edinburgh
Council and Police Scotland, these shall not be provided on this occasion.
Under the terms of the legislation, a request for information can be
refused where one or more exceptions listed in the legislation apply. In
this instance, the Council is claiming the following exception to the
information that you have requested:

 

Regulation 10(5)(e) – This exception applies to information where
disclosure would, or would be likely to, prejudice substantially the
confidentiality of commercial or industrial information where
confidentiality is provided for to protect a legitimate economic interest.

 

The certificates include commercially sensitive material such as
stewarding numbers and duties (agreed between the club, Police Scotland,
the appointed company and the Local Authority).

 

The numbers of stewards required and details of their duties is
commercially sensitive and therefore cannot be released. The appointed
companies go through a competitive tender process. The release of the
information would adversely affect the competitive nature of future tender
processes.

  

For Regulation 10(5)(e) to apply, the ‘public interest test’ set out in
the legislation also needs to be considered. Although there is a clear
public interest in the Council promoting transparency and accountability
through the disclosure of information relating to safety certificates, in
this instance I consider the public interest is best served by withholding
the information. Disclosure of commercially sensitive information
contained within the certificates would cause substantial harm to both the
Council seeking to ensure the safety of the citizens of Edinburgh and the
appointed companies.

 

Please note that this letter constitutes a formal refusal notice under
regulation 13 of the Environmental Information (Scotland) Regulations
2004.

 

Please further note that we can provide a blank template certificate
showing the standard conditions should this be required.
