Council (ACC) has completed the necessary search for the information
requested. Our response is now detailed below.

 

In light of recent Police reporting regarding safety certificates at
football stadia, could you please provide details (including copies if
possible please) of the most recently granted safety certificates for all
SPFL clubs within your remit along with details of any remedial
works/adverse findings from inspections? Just the most recently performed
certificates as detailed in the request. The time frame would depend on

FOI-19-0354 – AFC Post Match Inspection 8.12.18 report

 

Please note, there is a recommendation from the Sports Ground Advisory
Working Group to Aberdeen Football Club which relates to the health and
safety of attendees at Pittodrie. ACC has concerns that releasing this
information will have a detrimental impact on the health and safety of
attendees as it will allow sensitive information to be in the public
domain.

 

ACC is unable to provide you with information on the recommendation
relating to Health and Safety contained within the attached document as it
is exempt from disclosure.  In order to comply with its obligations under
the terms of Section 16 of the FOISA, ACC hereby gives notice that we are
refusing your request under the terms of Section 39(1) – Health, Safety
and the Environment - of the FOISA.

 

In making this decision ACC considered the following points:

 

It is considered that the release of these specific details could
adversely impact on the operational effectiveness of Aberdeen Football
Clubs stewarding, security operations and their Security Matchday
Partners. This would inhibit the prevention and detection of crime, impact
on unacceptable conduct and may pose a threat to the safety of people
within the stadium. Aberdeen Football Club have confirmed that they
consider the release of specific details would compromise their Matchday
safety and security operations.

 

Please note that third party names and personal details, as well as the
names of ACC Officers who are below Head of Service level have been
redacted (blacked out) from the correspondence as it is exempt from
disclosure. In order to comply with its obligations under the terms of
Section 16 of the FOISA, ACC hereby gives notice that we are refusing your
request under the terms of Section 38(1)(b) in conjunction with 38(2A)(a)
– of the FOISA.

 

In making this decision ACC considered the following points:

 

ACC is of the opinion that Section 38(1)(b) applies to the information
specified above as the information in question is personal information
relating to living individuals, of which the applicant is not the data
subject.  

 

Further, ACC is of the opinion that Section 38(2A)(a) applies, as we
consider that disclosure of this information would be a breach of the
‘lawfulness, fairness and transparency’ principle. ACC believes releasing
this information will allow identification, something which these
individuals have not consented to, and would have no expectation that ACC
would release.

 

As the Safety Certificate is otherwise accessible on our website at the
link provided above, it is exempt from disclosure.  In order to comply
with its obligations under the terms of Section 16 of the FOISA, ACC
hereby gives notice that we are refusing your request under the terms of
Section 25(1) - Information Otherwise Accessible - of the FOISA.

 

INFORMATION ABOUT THE HANDLING OF YOUR REQUEST
