FREEDOM OF INFORMATION ACT 2000 – INFORMATION REQUEST
Your requests for information in relation to specified care homes have now been
considered by the Southern Health & Social Care Trust and your requests will not be
processed. This applies to the following requests:
1. FOI 2016/384 – Seapatrick Care Home, 80 Lurgan Road, Seapatrick
2. FOI 2016/385 – Sandringham Care Home, 24 Sandringham Court, Portadown
This is because the aggregated costs of providing the information you have requested on
more than one occasion will exceed the appropriate limit, £450 or 18 hours work, as
stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
Consequently the Southern Trust is not obliged, under Section 12 of the Freedom of
Information Act 2000, to respond to your requests.
Under Section 12 (4) (b) if two or more requests are made to a public authority by one
person or an organisation within any period of sixty consecutive working days, then the
estimated cost of complying with any of the requests is taken to be the estimated total
cost of complying with all of them.
In accordance with the Freedom of Information Act 2000 this letter acts as a Refusal
Notice.
However we are able to provide the attached response which covers all homes used by
the Southern Trust for information similar to your request.
If you are unhappy as to how this request has been handled, you should write to Mrs
Claire Graham, the FOI lead for the Trust.
If, after receiving a response, you remain unhappy, you can refer your complaint to the
Information Commissioner at The Information Commissioner’s Office, Wycliffe House,
Water Lane, Wilmslow, SK9 5AF. It is important to note that if you refer any matter to the
Information Commissioner, you will need to show evidence of having gone through the
Information Governance Team, Ferndale, Gilford
Trust’s complaints procedure to try to resolve the matter with the Trust in the first
instance.
