Dear City of York Council,

In April 2022 Mr Ferris made an urgent delegated ( according to him) decision to spend £400k on ‘the carriageway’ (private land) at Springfield Close. This was a dead end, there was no road but in view of his asserted powers he used urgency principles to agree this.

As this land other than a narrow footway was all owned and under the control of a private land owner with frontagers and the Foss drainage board all involved please provide the following:

1. An excel sheet of all costs to date over the last 3 financial years to include but not limited to all remedial works, construction, surveys, design and legal costs. Staffing costs, by department, including legal and which of those if any were capitalised.
2. Any contractural commitments including costs committed to as at the start of FY 23/4 but not paid out
3. Provide all recorded information on measures taken to extract funding from Frontagers, Foss Drainage Board and the Land owner
4. All legal agreements to enter in on private lane.
5. The legal status of the highway and culvert you have now built at taxpayers expense, and all limitations regarding usage, weight limits and legal liabilities including for health and safety of the road users.

Please see below the response to your enquiry under the Freedom of
Information Act (FOIA). Please accept the councils sincere apologies for
the delay in responding.

Please see below the costs that have been charged to Springfield Close
since 1^st April 2020 and provide up to 30th September:

     Retention payment due to the contractor £5534.06  plus VAT due March
2024

WSP Invoice no 64639165 for Aug 2023 valued at £1075.51+VAT has not yet
been paid

 

3.    Provide all recorded information on measures taken to extract
funding from Frontagers, Foss Drainage Board and the Land owner

 

This has previously been answered in response CGT10953 therefore it is
exempt from disclosure under section 21 of the FOIA as it is already
accessible by other means

 

4.    All legal agreements to enter in on private lane.

 

This information is exempt from disclosure under section 21 of the FOIA as
it has already been provided to you in a previous response. See CGT10953

 

5.    The legal status of the highway and culvert  you have now built at
taxpayers expense, and all limitations regarding usage, weight limits and
legal liabilities including for health and safety of the road users.

 

The adopted highway boundary has not changed following the works. The
footway remains adopted highway. The rest is a privately maintained
street. There are no weight limits in place.
