Sprake & kingsley

South Norfolk District Council did not have the information requested.

Stuart Hardwicke CARRUTHERS

Dear South Norfolk District Council,

Please provide copies of any documents related to fraud investigations initiated by the Council involving Sprake & Kingsley Solicitors and its own legal team taking into account that Sprake & Kingsley Solicitors have certified that they incurred the expenditure certified to have been paid by the Council related to meadows at Denton when the Council have provided copies of invoices identifying that they incurred the expenditure. The Council's consultant to the Court has certified as far as can be determined that Sprake & Kingsley Solicitors have acted wrongly, and in a way that would not be expected if consumers of legal services are to have trust and confidence in their activities.

Please confirm that Sprake & Kingsley Solicitors have been excluded from provision of legal services to South Norfolk District Council. Please also identify how many local authority searches obtained by Sprake & Kingsley Solicitors have subsequently been identified by the Council as being defective due to mistakes being made by the Head of Planning Services.

Please further confirm due to the seriousness of the issues that the Council has reported Sprake & Kingsley Solicitors to their regulators and all legal representatives involved in the false billing identified.

Yours faithfully,

Stuart Hardwicke CARRUTHERS

I refer to your Freedom of Information request to which I am now in a position to respond. My response is outlined below. For clarity, I have broken your request into sections and answered each in turn.

a) Please provide copies of any documents related to fraud investigations initiated by the Council involving Sprake & Kingsley Solicitors and its own legal team taking into account that Sprake & Kingsley Solicitors have certified that they incurred the expenditure certified to have been paid by the Council related to meadows at Denton when the Council have provided copies of invoices identifying that they incurred the expenditure. The Council's consultant to the Court has certified as far as can be determined that Sprake & Kingsley Solicitors have acted wrongly, and in a way that would not be expected if consumers of legal services are to have trust and confidence in their activities.
Under section 1(1)(a) of the Freedom of Information Act 2000, I am advising you that the Council does not hold the information you have requested as investigations referred to in your request have not been undertaken.

b) Please confirm that Sprake & Kingsley Solicitors have been excluded from provision of legal services to South Norfolk District Council.
No such decision has been taken, therefore under section 1(1)(a) of the Freedom of Information Act 2000, I am advising you that the Council does not hold the information you have requested.

I hope this is of assistance and is sufficient to meet your requirements, but if, for whatever reason you wish to get back to me, please feel free to do so. In particular if you are unhappy with the information provided or how your request was handled please let me know and I will explain how you can request an internal review of our decision.

Please quote FOI 13-237 in any further correspondence concerning this request.
