- Location means the actual location that a SpeedWatch session was held as recoded on the submission and recorded by the police system, either as village name, postcode, Site No (ie 35SW001 - Chatteris Road, Somersham with the mapping of code against location), Road/Junction etc

- Dates recoded are either the date that the session was actually held, as recoded on the submitted session sheet, or the date received by the police of a session sheet.

In order for me to progress with this request, please could you provide
this office with further information.

 

Having conducted all relevant searches I have located information relevant
to your request.  However, that information does not fullfill all the
criteria of your questions for the following reasons:

1.         The data retained by the constabulary does not list ALL
Speedwatch sessions since the records contain only the details of those
vehicles which were observed as being over the threshold set.  It is
therefore possible that we do not hold data on sessions where no vehicle
was observed exceeding the threshold. 

 

2.         I will need to conduct a public interest test in respect of the
dates recorded on our systems since concern has been expressed that
release of specific dates could lead to a pattern of enforcement being
established.  If the potential for harm is confirmed, I will not release
these dates and will iterate my reasoning in my response.

 

Please confirm that you would be happy to receive the information as
defined within point (1) above.  In respect of point (2), I would be
prepared to provide the location data and total number of dates recorded
during the period in review.  Thus the response might show: Thrapston
Road, Brampton x12; meaning that 12 separate dates are recorded at that
location during the past 12 months.  I can see no harm in providing this.
Kindly indicate whether this is an acceptable alternative to you: it is
also more in keeping with the previous request submitted under
FOI0039-2016.

 

After receiving your reply, your request will then be considered and you
will receive the information requested within the statutory timescale of
20 working days as defined by the Freedom of Information Act 2000, subject
to the information not being exempt or containing a reference to a third
party.

 

However, if the requested additional information has not been received by
14 days from the date on this email, I will assume you no longer wish to
proceed with this request and will treat it as withdrawn.

Thanks for your reply. I have a couple of questions and points for clarification please.

You said.

Having conducted all relevant searches I have located information relevant
to your request. However, that information does not fullfill all the
criteria of your questions for the following reasons:

1. The data retained by the constabulary does not list ALL SpeedWatch sessions since the records contain only the details of those vehicles which were observed as being over the threshold set. It is therefore possible that we do not hold data on sessions where no vehicle was observed exceeding the threshold.

The April 2015 SpeedWatch Guidelines specifically require NULL Returns to be submitted. Therefore no session should not be in the records even if no vehicles are detected/reported. Thus the location should still have an output possible even if listed separately as sessions with null returns. To save you looking it up, the April 15 Guidelines clearly state:

<<A suitable record sheet template for use at the roadside is shown at Annex H. Nil returns also provide data and should be recorded. At the end of the operation, and within 48 working hrs, this information should be passed to a designated Point of Contact in the Business Support Unit, who in turn will arrange for its timely processing.>>

Is this correct?

2. I will need to conduct a public interest test in respect of the dates recorded on our systems since concern has been expressed that release of specific dates could lead to a pattern of enforcement being established. If the potential for harm is confirmed, I will not release these dates and will iterate my reasoning in my response.

Please note the central point is that SpeedWatch is ‘not’ enforcement. It is required to operate kerbside from fixed locations with highly visible volunteers carrying out regular sessions with adequate advance signage. Even being kerbside in hi-viz allows the identification of individuals by passing drivers. That mandated exposure is something that has the potential to be more harmful than publishing the list of results because even the least astute observer can quickly establish any pattern of operation if indeed any driver had the time and inclination to do that. I cannot see how those facts can be reconciled with your criteria/reason for applying an ‘enforcement pattern’ Public Interest Test to the list I requested.
That said, in the interests of serving my need for specific data, and assuming you are still not prepared to publish the full list, I would be prepared to compromise by initial request by accepting your variation at (2) but for

A count of sessions for each location for each month of the 12 month period back from the latest full month from which you are able to start (say 31 Mar 16 back to 1 Apr 15 inclusive). The list should include the Location Code used by your system so that any resultant query can be accurately addressed back to you. Please supply in Spreadsheet/Excel format

The simple answer to your questions is that the null returns are not required to be retained and so are not. What is retained are the details of the location, date and vehicle details of those to whom letters will be issued. As I have clearly pointed out I am happy to give location and frequency in respect of the 12 months data already retrieved: I disagree regarding pattern of enforcement and if you wish the information to be broken down by month then I shall have to apply the public interest test.

Speedwatch information is to be published within our transparency information (and will cover the period requested) in due course.

Please confirm you are content with my proposal as previously outlined.

Your comment suggests to me that you should perhaps frame your request in the way which you believe will allow for the extraction of the information which you require. To do otherwise would indicate a lack of purpose at best.

I have been trying to obtain the information which I believe you hold since December 2014.

In your last response you indicated that there was some data which you were able and prepared to release.

To try and bring this to an end, and at least obtain some information which may fulfil my requirements I have compromised and accepted your offer. Until I receive that I can obviously have no idea whether it does fulfil my requirements, so please go ahead and supply as offered. (quoted below)

number of speedwatch sessions held at that location and no conclusion
should be drawn.

designed to protect forces from requestors who seek to abuse their rights
under the Act in a deliberate attempt to disrupt or impact upon public
functions of that authority.  I would advise that further requests of a
similar nature relating to SpeedWatch may be considered for refusal under
this section of the Act.

Thank you for this list, most enlightening and does answer most of my questions.

It is interesting to see that from the original claim by the constabulary of 250 Active Speedwatch villages, this list show only 81 villages having run sessions over the last 12 months and only 61 with more that 2 sessions!

I would however also like to understand why you believe that am potentially seeking to abuse my rights to submit this FOI as per your comments below?

In providing the requestor with this response I must bring to your
attention the provisions of s14(1) and s14(2) of the Act which are

It was provided to me in an xls spreadsheet and reformatted using a pivot table, which is the standard way of doing so.

The information has been provided to you in the form agreed through clarification and fully answers your questions: to reformat it in the manner suggested is likely to attract exemptions under the act and this was explained to you previously.

The table you have is the table thus created! It is a simple matter to copy and paste it into an email as you probably know and prevents reverse engineering or a back door into the original files.
