Thank you for your request for Information, received at this office on 16
October, 2017, in which you requested details of the following:
 
 

* The number of speeding fixed penalty notices that have been issued by
HUMBERSIDE Police for the following vehicle Registration Number YX08
FBA in the last 24 months.

 

* If it is possible,  do you also hold number of speeding offences
against this vehicle by other Police forces.

 
 
The Freedom of Information Act requires that this request is dealt with in
a manner that is motive and applicant blind.  A disclosure under this
legislation is considered a disclosure to the world and is considered to
be on the basis that it is in the public interest.
 
Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at Section
1(1)(a) is to confirm or deny whether the information specified in a
request is held.  The second duty at Section 1(1)(b) is to disclose
information that has been confirmed as being held.  Where exemptions are
relied upon Section 17 of FOIA requires that we provide the applicant with
a notice which: a) states that fact b) specifies the exemption(s) in
question and c) states (if that would not otherwise be apparent) why the
exemption applies.
 
It has been determined to provide information on a single vehicle would
possibly identify a living individual.  Therefore section 40(2) of the Act
is engaged.  As section 40(2) is an absolute exemption there is no
requirement for me to conduct a public interest test. However I am
satisfied that disclosure would breach the 1^st principle of the Data
Protection Act – fair and lawful processing.
 
The information you are requesting may qualify as your own personal data,
If you are the driver/keeper of this vehicle you can fill in the Subject
Access application which I have attached for you.
 
For this information you would need to fill in a Subject Access
application with two forms of ID (one with photo) and in section 2 state
the information you are requesting. This can be done via post to;-
Information Compliance Unit, Humberside Police, Clough Road, Hull, HU5 1SW
or be taken to your local police station. The timeframe for completion of
a Subject Access is within a 40 day period.

Thank you kindly for this information. I would like request an internal review of your response, I have rephrased my initial question; as I am not requesting personal information about any living human being or indeed a vehicle owner. I would request you could consider the following rephrased question:

1. How many (in number only) speeding offences have been issued against Vehicle Identification Number YX08 FBA in the last 24 months?

Secondly, I am not requesting information on a person or to identify a living individual, your initial response to state 'it has been determined to provide information on a single vehicle would possibly identify a living individual' - the answer (in numbers only) would identify how many potentially innocent people that may be a victim to a speeding offence that is not their fault. I have at no stage requested information that could possibly identify anyone.

It is therefore in the public interest to request this. Thank you for your support in the matter and I would appreciate your response within the time-frame stipulated.
