Your Chief Superintendent Jane Derrick has been promoting the launch of a new unit within Sussex Police the ‘Specialist Enforcement Unit’ or SEU for short.

Please can you provide all documentation in relation to this unit for example officer and equipment numbers, bases, role, shift patters, aim and objectives and any specialist training the officers will undertake along with that training material.

I am writing to request an internal review of Sussex Police's handling of my FOI request 'Specialist Enforcement Unit'.

You’ve significantly exceeded the timescale provided in the legislation and your own extension by some margin.

I require you to release the information in full within 7 days or I will report the matter to the Information Commissioner for breach of the legislation with a view to enforcement action against Sussex Police.

I am writing to request an internal review of Sussex Police's handling of my FOI request 'Specialist Enforcement Unit'.

Following discussions with the Information Commissioner’s Office I suggest you are still in breach of the FOIA.

I don't believe that your claim that the sited exemptions are applicable to the whole of the documentation requested and that it would be reasonable to release the information perhaps with certain sections redacted.

Further, you haven't addressed why Sussex Police breached the FOIA in the handling of this request and requiring the ICO to intervene to even get the woefully inadequate reply so far.

Firstly can I apologise for the slow service that you have had, the Sussex FOI team has been dealing with increased demand resulting in a backlog of work and it has taken some time to secure the funding and resources to increase their capacity, which is now in place.

Your original request was:

Please can you provide all documentation in relation to this unit for example officer and equipment numbers, bases, role, shift patters, aim and objectives and any specialist training the officers will undertake along with that training material.

I have interviewed the FOI officer who originally dealt with your case, review his response to you, and I have reviewed the document set assembled as part of our information search process.

It is my view that the exemption of Section 31 (a) (b) (c) Law Enforcement was correctly applied. Section 31 https://www.legislation.gov.uk/ukpga/200... amongst other material exempts information that:

Would be likely to, prejudice—
(a)the prevention or detection of crime,
(b)the apprehension or prosecution of offenders,
(c)the administration of justice,

Having review the variety of document collated it is my view that in answering your question on ' officer and equipment numbers, bases, role, shift patters, aim and objectives and any specialist training the officers' would prejudice the effectiveness of those units. In that they would provide data on where those staff are and respond from, their capacity, their tactics, their resources etc, all of which would make them less effective. I therefore refuse to make this disclosure under section 31 of the Act. Please see the original response for the balance argument for this decision.

As you are aware you have a right to appeal this decision with the ICO, who have informed me that you have already contacted.
