Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),
You can not include redaction time when applying section 12 please see this ICO guidance https://ico.org.uk/media/for-organisatio... .
If after removing from your estimate redaction time you still think question 4 exceeds the appropriate limit please search the inboxes of:
Anthea Liptrot,
Dr Walsh,
Dr Balakrishnan.

Could you also please confirm whether you will publish all datasets released under my requests on your Trust website? As a public authority this is a requirement under section 19(2a) of the Act as amended by the Protection of Freedoms Act 2012.

Yours sincerely,

James Apperley

Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),
Just to clarify in the above ICO guidance I provided on the appropriate limit on page 4 paragraphs 15-17 make clear that time taken to redact personal data can not be counted towards the appropriate limit, in this case 18 hours. For your reference here is a link to the guidance again https://ico.org.uk/media/for- organisations/documents/1199/costs_of_compliance_exceeds_appropriate_limit.pdf . I would think excluding redaction time you can search the inboxes of the 20plus staff. However if you can show me that this is not the case please search the inboxes of:
Anthea Liptrot,
Dr Walsh
Dr Balakrishnan and as many senior leaders at the West Midlands Rehabilitation Centre at the clinic as the appropriate limit permits.

Yours sincerely,

James Apperley

Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),

Apologies for yet another message (see my other messages above) but given that the appropriate limit doesn't include redaction time for personal data (see ICO guidance above) I suggest you also check the inbox of Andrew Kirby. You can exclude any emails between myself and Trust staff in your search for data for question 4.

Yours sincerely,

James Apperley

Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),
I mean Richard Kirby not Andrew Kirby, apologies please see above messages.

Yours sincerely,

James Apperley

Dear Rob,
While as explained about ICO guidance makes clear you can not include redaction time in the calculation of the appropriate limit in section 12 of the FOI Act I do not wish to inconvenience 20plus staff in connection to the emails referred to in question 4. With this in mind I would instead ask that you check the inboxes of the staff you think are most likely to have relevant emails in scope of question 4. You do not need to include emails between myself and Trust staff on this issue.

Yours sincerely,

James Apperley

Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),

Following my feedback can you please give me an update in respect to question 4?

Yours sincerely,

James Apperley

Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),

Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),

Can you please explain to me what you are doing following my feedback in respect to question 4?

Yours sincerely,

James Apperley

Dear BCHC, Foi (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST), Rob Neil
You have ignored my requests for an update regarding question 4 on emails. Can you please update me on this? I have made some constructive suggestions and have also pointed out that under ICO guidance redaction time can not be included in a calculation for the appropriate limit. I look forward to hear you very soon.

Yours sincerely,

Dear James,

I have been liaising with the Clinical Group Lead and the Spasticity Team
Lead about your refined request.

Processing your request using a search criteria of ‘Staffing, Capacity and
Demand’ is producing a huge number of results and will certainly take well
in excess of 18 hours to determine which information is relevant, before
then retrieving and extracting that information.

Following further discussion with the Clinical Group Lead and the
Spasticity Team Lead would you be willing to meet with us to agree the
best way forward for us all? We do really want to help you with your
request and maybe by discussing your requirements directly with our
clinicians we could refine your scope further and get you the information
that you want.

Please also note that when you refined your request we treated this as a
‘new’ request to reset the 18 hours. It therefore has a completion date of
12 April. The reference number for this request is FOI Request ID
2023-03-13(1). Please accept my apologies if you have not been informed
about this previously.

Kind regards

Dear Rob (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST),
Thank you for your message and your kind offer of a meeting it is appreciated. I am looking for any emails/ internal reports describing the need for greater funding and/or staffing in the spasticity service, I'm afraid I can't be more specific than that. I would like any search to minimise inconvenience for relevant clinicians. While I am in principle happy to have a Microsoft Teams meeting I am very aware of the capacity pressures on clinicians and am reluctant to take up their valuable time. The purpose of my requests is simply to identify capacity issues in the hope more resources can be made available to improve services for all patients. If a search for emails/internal reports is going to take many hours of clinicians' time I am content to withdraw question 4.

Yours sincerely,

James Apperley

NEILL, Rob (BIRMINGHAM COMMUNITY HEALTHCARE NHS FOUNDATION TRUST), Birmingham Community Healthcare NHS Foundation Trust

Dear James,

Thank you being understanding on this matter. As we know the pressure on clinicians is very high throughout the NHS. I will inform them that Q4 has now been withdrawn.

We also had some positive news from our Comms Team literally moments ago. I believe that Mike will be contacting you very soon to say that the data sets will be published soon!

Kind regards

Rob
