South Yorkshire Police Presence - Rustling Road 17th Nov

Dear South Yorkshire Police,

On 17 November 2016 South Yorkshire Police dispatched police officers to Rustlings Road to oversee and keep the peace while Sheffield City Council contractors carried out their work on Rustlings Road.

• Did Sheffield City Council or it's contractor request this police prescence, if so when was the request made?

• Was South Yorkshire Police aware of any specific threats to public safety, if so how many and when was SYP made aware?

Could you please contact the relevant departments in SYP who would usually hold the infomation requested and source as ncessary.

Would it be possible just to seek an additional clarification on a couple of points.

*** In October 2016, Sheffield City Council (SCC) and their contractor Amey, approached South
Yorkshire Police (SYP) with a view to SYP supplying appropriate support to their planned
tree felling activity. ***

When in October 2016? Start of the month end of the month? If possible date formal request for prescence was requested.

*** Police officers were utilised during the SCC led tree felling operation, based on the threat
and risk assessment undertaken, the potential protest activity and the fact there were to be
eight work sites spread over an area that extended over 900 metres.***

Was the risk assesment undetaken by SYP or SCC? When was SYP in it's posession, Would it be possible to recieve a copy? Redacted if nescessary.

I think that would fulfil the answer to my orginal request:

many and when was SYP made aware?

I am writing to advise that we believe that we need further time in which
to provide a full response to you.

 

We consider that the exemption under section 31 (Law Enforcement) of the
Act applies to the information you have requested.  We now need further
time in which to consider the public interest in disclosing the

Thanks for your response.

I have looked at Section 31 and can’t understand how you intend to apply it. From your previous response I understand the operation where Police officers were utilized was “SCC led”.

Section 31(1)

The event in question has passed, the information sought will not impinge on the prevention or detection of crime, offenders/residents related to this incident have already been apprehended (and public discussion in local papers).

Section 31(1)(d,e,f,g,h,i) Are not applicable.

Section 31(2)(a,b,d,e,f,g,h,i,j) Are not applicable.

Section 31(3) Not applicable.

If you decide to cite Section 31 and withhold information, please explain in detail how you applied public interest test. The prejudice must outweigh the clear public interest in this disclosure.

There is an overwhelming public interest in this issue. There has been local and national media coverage, The Star, BBC, Sky News, ITV. Former Deputy PM Nick Clegg has also spoken about SYP police involvement with the operation.

My first FOI request to SYP (20161422) regarding this issue, of which this is a follow up / clarification was cited in The Star

I feel that any reasonable observer would agree the information sough would not prejudice the prevention or detection of crime.

Brian Lodge and SCC have publicly stated the events that happened on Rustlings Road will not be repeated, therefore law enforcement interests protected by section 31 will not harmed by the disclosure of materials related to the incident.

SYP must clearly identify real, actual and of substance harm that will be caused to SYP and its operations by releasing this information, since operation was “SCC led” I feel there is no harm in disclosure.

Dear FOI,

I appreciate you are still working through documents, however this request is long overdue.

Would it be possible to provide a partial release of the information I have sought and the FOI team has completed working through?

In your response on the 9th January 2017 it was stated "It may be necessary to liaise with third parties involved." Can you also confirm that the liaising with 3rd parties is complete. If the liaising with third parties is not complete, can you please identify the third party, and if is delaying the process so I can raise the issue with the ICO.

Dear FOI Team,

Could we please have some movement on 20161470.

It has been chased by phone mid March, at that point I was advised documents were still been reviewed.

Can you please advise the status, and a deadline for disclosure. The timescales within which a
SYP under section 1(1)(b) of the FOI to provide information are long overdue. And an open ended date for production does not adhere to the FOI guidelines.

The additional 20 working days to consider the public interest test have elapsed, and from the telephone conversation I had with Ms Moore and previous correspondence indicate SYP FOI unit was working through the documents requested for release.

Under section 17(1) SYP has a duty to issue the requester with a refusal notice
within the time for compliance with section 1(1), since this has not been actioned it's safe to assume no refusal notice will be issued.
