Source of Authority

Marc Horn made this Freedom of Information request to House of Commons This request has been closed to new correspondence. Contact us if you think it should be reopened.

Response to this request is long overdue. By law, under all circumstances, House of Commons should have responded by now (details). The person who made the request can complain by requesting an internal review.

Dear House of Commons,

Acts of Parliament claim their authority from:
"Be it enacted by the [Monarch]'s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament
assembled, and by the authority of the same,..."

Please provide the documentary records you hold creating this authority for each party to an act of parliament as Act of Parliament claim it is by their own authority as
"and by the authority of the same".
This is an admitted expressed self proclaimed authority.

Please provide the documents creating the authority for:
1 - The Monarch, and
2 - The Lords Spiritual, and
3 - The Lords Temporal, and
4 - The Commons.

Yours faithfully,

Marc Horn

Dear Marc Horn,

Freedom of Information Request F23-594

Thank you for your request for information as copied below. You asked the
House of Commons two questions regarding documents held on the authority
of specified groups, which we have sought to answer below.

Acts of Parliament claim their authority from:

"Be it enacted by the [Monarch]'s most Excellent Majesty, by and with the
advice and consent of the Lords Spiritual and Temporal, and Commons, in
this present Parliament

assembled, and by the authority of the same,..."

 1. Please provide the documentary records you hold creating this
authority for each party to an act of parliament as Act of Parliament
claim it is by their own authority as "and by the authority of the
same".

and

 2. Please provide the documents creating the authority for:

 a. 1 - The Monarch, and
 b. 2 - The Lords Spiritual, and
 c. 3 - The Lords Temporal, and
 d. 4 - The Commons.

In the first instance, please note that the Freedom of Information Act
2000 (FOIA) only gives you the right to request access to recorded
information which may be held by a public authority. We therefore
considered what records we may hold to answer your request.

However, to identify any legislation or recorded information relevant to
your query, an expert legal analysis would be required. Like any public
authority, the House of Commons has a duty to provide a requester with
advice and assistance as far as it is reasonable, but our obligation does
not extend to us having to first carry out this analysis on any
legislation or recorded documentation held.

We do not provide legal advice or analysis to requesters, so we suggest
that questions on any laws and their application may be best directed to a
solicitor, barrister or other suitably qualified legal professional.
Alternatively you may wish to consider contacting Citizens Advice. Contact
details can be found at: [1]http://www.citizensadvice.org.uk/.

You may, if dissatisfied with the handling of your request, complain to
the House of Commons. Alternatively, if you are dissatisfied with the
outcome of your request you may ask the House of Commons to conduct an
internal review of any decision regarding your request.  Complaints or
requests for internal review should be addressed to: Information
Compliance Team, Governance Office, House of Commons, London SW1A 0AA or
[2][House of Commons request email].  Please ensure that you specify the full
reasons for your complaint or internal review along with any arguments or
points that you wish to make.

If you remain dissatisfied, you may appeal to the Information Commissioner
at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF,
[3]https://ico.org.uk/.

Dear House of Commons,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of House of Commons's handling of my FOI request 'Source of Authority'.

I am not asking for legal advice!

I am asking for documents from the public records you hold which should be readily available as without them you cannot prove authority for your actions!!!

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/s...
