Dear Mr Wolkowski

 

Thank you for your email dated 18 May 2019, in which you ask for the
number of social workers who have been struck off for misconduct in public
office.

 

Your request has been handled under the Freedom of Information Act 2000
(FOIA).

 

We are unable to provide you with the information you have requested as
the information is not held in an easily accessible format. In order to
provide you with a full response we would need to manually review all
fitness to practise cases for social workers where the registrant was
struck off because of misconduct to determine whether the registrant was
in public office at the time when the case was brought against them. This
would exceed the appropriate cost limit under Section 12 of the FOIA, that
being £450.

 

Staff time can be charged at £25 per hour, this equates to 18 hours before
the limit is met. We estimate that to access each case file and extract
the information you have requested would take 10 minutes per case. There
have been 222 cases brought against social workers where the registrant
was struck off because of misconduct. 222 multiplied by 10 minutes equates
to 37 hours, therefore exceeding the cost limit.

I write in response to your request for a review of the HCPC’s response to
the freedom of information request you made.

 

Original request

 

Your request dated 18 May 2019 asked for the number of social workers who
have been struck off for misconduct in public office.

 

We explained that the information you requested is not held in an easily
accessible format and as such, we would need to manually review all social
worker fitness to practise cases where the registrant was struck off due
to misconduct, to determine whether the registrant was in public office at
the time when the case was brought against them.

 

We applied the cost exemption in Section 12 of the Freedom of Information
Act 2000 (FOIA), as a manual collation of data would exceed the cost
limits under the FOIA. We provided an estimate of the amount of time it
would take to provide you with a full response and therefore the cost that
would be incurred.

 

Internal review

 

Having considered the HCPC’s response to you, I can confirm that the
information is exempt under Section 12.

 

We do not record whether a registrant is in public office at the time of
receiving a fitness to practise complaint about them. A manual review of
cases would therefore need to be conducted. The cost of collating the data
would exceed the limits under the FOIA and would place disproportionate
burden on the HCPC’s resources.
