1. How many members of social services' staff were disciplined, reprimanded, sacked, given official warnings etc in 2016? Please give an answer to the best of your ability i.e. if your dataset is incomplete say so and disclose what you have.

2. Please give full reports of each incident? For example: sacked Sonya for being sodomised by a stiletto whilst carrying out a home visit.

unclear whether you mean only social workers or any front line staff or
any staff within the social services directorate.

Thank you for your recent FOI. Please find below our response:

1. How many members of social services staff were disciplined, reprimanded, sacked, given official warnings, etc in 2016?

To set the figures below in context, there are approximately 1450 members of social services staff working at North Yorkshire County Council. A total of 23 members of social services staff were disciplined in 2016. The following actions were taken:

final written warning issued 8
informal management action taken 6
resigned number withheld
dismissed <5

Unfortunately I am unable to provide you with some of the figures because of the low numbers involved. Figures of 5 or less have been withheld along with the number of resignations. This is because the numbers are so low that it is possible that those who already know, or can deduce, the identities of those concerned would learn facts about them that it would be unfair for the Council to disclose. Therefore the numbers are withheld under Section 40(2).

I have attached a copy of the appeals procedure for your information.

2. Please give full reports of each incident.

I can confirm that the Council holds this information. Unfortunately I am unable to provide you with the full details of each incident as we consider this to be personal information. Section 40 (2) of the Freedom of Information Act 2000 exempts personal information from disclosure if disclosure would breach one or more principles of the Data Protection Act 1998 (DPA). In this case we consider that disclosure would breach the first principle, namely that personal information must be fairly and lawfully processed and must meet one of the conditions for processing as provided by schedule 2 of the DPA. In this case we consider that the disclosure would be unfair and none of the conditions for processing would be met.

Whilst we cannot detail each incident I can confirm that the staff were disciplined for the following reasons:
• Theft or attempted theft
• Negligence in performance of duties
• Personal misconduct occurring outside the workplace
• Unprofessional conduct and language at work
• Physical, verbal or indecent assaults
• Behaviour which would bring the County Council into disrepute
• Unjustified refusal of a reasonable instruction

Thank you for your email requesting further information about "Personal
misconduct occurring outside the workplace".

 

Individuals may be arrested and summonsed in connection with a wide
variety of possible offences which may or may not have an impact on their
employment dependant on the nature of their posts and the nature of the
alleged offence.  In certain occupations, especially those that deal with
children and vulnerable adults, employees need to be particularly aware of
the requirements of occupational and professional codes of conduct as well
as safeguarding guidance and workplace expectations.  Such occupations
would include Family Support Workers, Education Social Workers, Youth
Workers, Teachers, Teaching Assistants and others who work with
young/vulnerable people.  Examples of civil offences are:

•Anti-social Behavioural Orders (ASBOs)

•Parenting Orders
