Request for information under the Freedom of Information Act
2000/Environmental Information Regulations 2004
Further to your recent request for information received on 17^th March
2022. The Council has assessed if your request should be handled under the
Freedom of Information Act 2000 and concluded that it should be dealt with
under the Environmental Information Regulations 2004 (EIR), which is the
legislation that applies to requests for information which relate to the
environment, including the use of land and the built environment.
You requested:
How many homes for social rent are planned to be constructed within
Bolton's:

Our Response
Neither the Places for Everyone (PfE) nor the Local Plan provide any
detail down to the individual site level nor by year bands as requested.
Regulation 12(4)(a) of the EIR provides an exception to the release of
Environmental Information where the public authority does not hold that
information when an applicant’s request is received. In this case Bolton
Council does not hold the information you require.
In accordance with Regulation 9(1) of the Environmental Information
Regulations, “A public authority shall provide advice and assistance, so
far as it would be reasonable to expect the authority to do so.” I can
inform you that there are no housing allocations within the Places for
Everyone in Bolton, only 3 Green Belt releases for employment. Policy
JP-H2 on affordability in PfE sets out to deliver across Greater
Manchester 50,000 affordable homes 2021- 2037, with at least 60% being for
social rent or affordable rent. There is no breakdown of the 50,000 to
the district level.
Bolton’s [1]Core Strategy policy SC1 sets out a housing target of 694
dwellings per year 2008-2026. In doing so the policy aims to ensure that
35% of housing delivered is “affordable” broken down into 75% for social
renting and 25% for intermediate housing.

Under Regulation 11, you are entitled to make representations to us if it
appears that we have failed to comply with a requirement of the
Regulations in relation to your request. Representations must be made to
us no later than 40 working days after the date you believe we failed to

We will then consider your representations and supporting evidence and
decide if we have complied, notifying you of our decision as soon as
possible, and no later than 40 working days after the date of receipt of
your representations.
Under Regulation 18, you are then entitled to apply to the Information
Commissioner for a decision as to whether, in any specified respect, your
request has not been dealt with in accordance with parts 2 and 3 of the
Regulations.
