Social Housing Application - medical information

Dear Ministry of Housing, Communities and Local Government,

Re: Social Housing List Application
A Google search tells me that local authorities ask for medical information, where relevant, , to support individual’s application for Social Housing.
Yet, the Department of Health reiterated in their DE 0000867779 dated 26th June 2014 that “local authorities are NOT entitled to ask for, or routinely receive, an individual’s confidential medical records, including information about a person’s HIV status.” There are NO exceptions.

I should be grateful for your clarification; how local authorities circumvent this restriction, when asking for applicant’s medical information. What is the relevant legislation permitting them to do so.

You have defaulted. If there was a legitimate reason for a delay, you were obliged to let me know,
As the matter stands today, it appears that there is NO valid legal reason for local authorities to ask for individuals' confidential medical information in the Housing List Application process.
Should you NOT respond within the next 14 DAYS, I will be entitled to assume that there IS NO legally valid reason for local authorities to ask for this information. They have been asking for it, in breach of the individual's right to Confidentiality and perhaps even without their CONSENT.
Furthermore, it will be in breach of Department of Health statement.

I Requested you to provide legal justification, with references, which permit local authorities to solicit, from whatever source, for whatever purpose, residents' confidential medical information,
