Notice of Refusal
We refer to your request dated 04/07/2024 11:54 for the following
information FOI: Details of Team Managers, Deputy Team Managers & Service
Managers for Children and Adults Statutory Social Care Services.
We confirm that the Council holds the information that you have requested.
We have considered your request, but are of the opinion that the exemption
under the following section of the Act applies to the information
requested:-
Section 38(1)(b) – personal data where the "first condition" is satisfied
The information falls within the definition of "personal data" in the
General Data Protection Regulation (GDPR), and the disclosure of the
information to a member of the public otherwise than under this Act would
contravene -
(i) any of the data protection principles in Article 5(1) of the
GDPR; or
(ii) disclosing the personal data would contravene Article 21 of
the GDPR (right to object to processing) and the public interest favours
withholding the data; or
(iii) the data subject would not be entitled to be given the
personal data if they made an access request for it under Article 15(1) or
Section 45(1)(b) of the Data Protection Act (2018) and the public interest
favours withholding the data;
We are of the opinion that this exemption applies because the information
you request constitutes personal data (as defined in the GDPR) relating to
third parties.
The First Data Protection Principle states: -
“personal data shall be processed lawfully, fairly and in a transparent
manner in relation to the data subject.”
The Article 6 conditions are not met. Article 6(1)(f) has particular
application:-
processing is necessary for the purposes of the legitimate interests
pursued by the controller or by a third party, except where such interests
are overridden by the interests or fundamental rights and freedoms of the
data subject which require protection of personal data, in particular
where the data subject is a child.
The circumstances of your request do not demonstrate that you have any
such legitimate interest in having these personal data disclosed to you.
Consequently disclosure would contravene the First Data Protection
Principle as being neither lawful nor fair.
This exemption is an absolute exemption and therefore we are not obliged
under the terms of the Act to provide you with the information requested.
