For the past seven financial years:
1. How much has the council spent on Adult Social Care (“ASC”) as a whole?
2. How much of the total ASC budget has been paid out as direct payments? What is the total number of hours that are being commissioned?
3. How much does the council spend on care providers directly commissioned by the local authority? Of this, how much is for domiciliary care support? What is the total number of hours that are being commissioned both in total and just for domiciliary care/support?
4. How much does the council spend on the administration of adult social care? Please include staffing costs e.g. management, support services, finance, secretaries, social workers or similar. It would be helpful if you could break this down by seniority and then include the number of employees in each category (i.e. social workers = X number of employees, costs X per annum).
5. Please indicate the total number of employees employed by ASC.
6. How many of your local authority’s customers are in receipt of a direct payment for Care Act services?
7. How many of your local authority’s customers are in receipt of support directly commissioned by the local authority? We are only referring to domiciliary care support.
8. As part of your duties under the Care Act, do you signpost Direct Payment users to support services such as payroll providers? |f so, which providers are signposted to?
9. Can you provide the names of the payroll providers used by your direct payment recipients, and how many direct payment recipient use each provider?
10. Does the council pay any payroll providers directly and if so, how much?

I am writing to request an internal review of Northumberland County Council's handling of my FOI request 'Social Care Spending England (Northeast)'.

Complaint one: Northumberland County Council (NCC) failed to provide the information I requested in breach of the Freedom of Information Act 2000.

In its response NCC confirms that it holds the requested information but does not provide this, instead providing a link to information on the NHS website giving a general overview of all social care spending in England. This overview contained some relevant second hand information but did not satisfy my request which asked for expenditure and figures relating to clearly specified categories i.e. expenditure on Direct Payments. (see bottom of webpage for response and note attached excel file as requested)

Complaint two: Failure to seek clarification of the request
NCC's response to my request includes the following statement before providing the links referenced in complaint one:

"We are not certain that we understand exactly what data you are
requesting, but we think that you can find answers to most of your
questions using published data."

I'm confident my request was clear as other Local Authorities have fulfilled the request, however, if NCC was unclear, it should have sought clarification without delay. Instead NCC waited 18 working days to raise this, which has obstructed my FOI request.

I trust, given the example provided, NCC now will release the requested information without further delay.

I am writing to request an internal review of Northumberland County Council's handling of my FOI request 'Social Care Spending England (Northeast)’ (Ref: 11459).

Your second attempt at responding to my review request apologised for your original response which you stated was sent in error, however you do not explain how it is possible to send a fully formed response in error. Your second response to my request does not attempt to address my concerns with your failure to provide requested information but rather attempts to justify it under section 21 of the Freedom of Information Act. Your response stated the following:

“We can confirm that we hold this information, and the information 
requested in your six following questions (with the exceptions noted 
below), but this information falls outside the scope of our duties under 
the Freedom of Information Act, since Section 21 of the Act provides that 
local authorities are not required to supply information which is

Your description of section 21 appears to have omitted a crucial component, section 21 only applies to information which is “reasonably accessible” by other means. As stated in my original review request, the documents you are referring to do not contain the information specified in the request. For example, expenditure on direct payments is broken down into demographics such as long term care 18-64 and then a separate figure for 65 and over. These figures are buried in an excel sheet containing a total of 1485 individual spending figures. This is within a document containing 15 similar sheets, which itself is one of 5 documents which compromise the report you pointed me to. This cannot be said to be “reasonably accessible”. More importantly, these figures are not the information I requested. I requested the total expenditure of direct payments, council commissioned care etc. The information in the documents the council point to is not the information I requested, instead the figures are divided into specific subcategories, i.e long-term care for clients aged 18-64. As a member of the public I do not have sufficient knowledge of the council’s internal working to calculate the figures of information requested from myself. Even if it were possible to calculate the total myself using the information provided, such calculations would be open to dispute.

To summarise, you simply haven’t provided the information specified in the request, and are in breach of the Freedom of Information Act as the information is not reasonably accessible by other means, therefore section 21 does not apply. This is the second time that I have brought these matters to your attention, I will wait until the 20th of January 2023 for a response before referring the matter to the ICO.

I have investigated the matter and have discovered that we do not hold the

are used by 18 DP recipients. We are aware that some other DP recipients
make arrangements for support with payroll in other ways, for instance by
using accountants already known to them, but we do not hold systematic
information about this.

 

Q.10    Does the council pay any payroll providers directly and if so, how
much?  

A.10    No.

 

Q.11    Please indicate the number of direct payment recipients that use
a) supported bank account, b) pre-paid and c) traditional payment into
client’s bank account (ie. separate account client uses only for their
direct payment)?

A.11     420 DP recipients have their payments made into a bank account
managed by one of the two payroll providers named above

 

The number of DP recipients using a pre-paid card is less than 5, and in
accordance with our usual practice we do not release numbers below that
level to avoid any risk to the confidentiality of information about
individuals

 

280 DP recipients receive funding through a traditional payment into a
bank account in their own name
