Dear Local Government Ombudsmen,

In the’ Adult Social Care’ section of your website you state that:
‘The LGO is the Social Care Ombudsman. We investigate all complaints about adult care services. It does not matter if your care is provided by a council or paid for yourself’.
As I could not find even a single reference to this title anywhere, except the LGO’s website, I should like know details about the Social Care Ombudsman.
Therefore, in accordance with the Freedom of Information Act, I request the following information about the Social Care Ombudsman:
1. When was he established
2. By whom was he established
3. In accordance with which legislation was he established
4. What entitles him to investigate complaints about adult care services
5. What are his statutory powers to investigate any complaints and enforcing his decisions on the care providers
6. Where can I find complete details of these statutory powers

Dear Ms Pook
Thank you for your response to my questions.
It was the Health Act 2009, Section 35 – Part 3, page 38 which amended the LGA 1974 by insertion of a new Part 3A, dealing with ‘privately arranged or funded social care’. NOT the 1999 Health Act, as you claim.
You are trying to make me believe that you and the rest of you are not aware of the provisions of paragraph 50 and 48 of the Health and Social Care Act 2008. Para 48 as amended by paragraph 293, Part 11 of the Health and Social Care Act 2012.
And this also concludes my reply in this matter, as it must now be considered by those in a much higher pay grade.
