From April 2015 local authorities have been responsible for assessing and meeting the social care needs of adult prisoners (not just on discharge from prison but also while in custody). All prisoners should be treated as if they are resident in that area for the purposes of the Care Act and for as long as they reside in that prison.
Prisoners are entitled to the support of an independent advocate in the same circumstances as people in the community. Local authority areas containing prisons have been advised by central government to build this into their plans for meeting the requirements of the Act.
On that basis, please can I therefore respectfully request disclosure of what the local authority currently has in place in relation to this issue including any policies, procedures or guidance relating to your authority and its statutory responsibility for prisoners residing within its area including that of any local prisons which come under your LA boundary.
