Dear Employment, Freedom of Information,

I believe you have incorrectly applied section 14 (2) to my request (reference 17593).

According to the ICO guidance:
http://www.ico.gov.uk/~/media/documents/...
Quote:
"Similarly, a request will be substantially similar to a previous request only if you would need to disclose substantially similar information to respond to both requests (ie with no meaningful differences). You should not refuse a request simply because it
relates to the same subject or theme as a previous request, unless you would have to give the same information in response.

If only some of the information you need to disclose is different, you should comply with the request, but you may want to supply only the new information and class the rest of the request as repeated."

My previous requests have dealt with a similar topic but over different time periods and using different criteria. The responses to this and previous requests would be different and shed further light on an important issue. It is unavoidable that one answer may lead to further questions to expose issues.

These are legitimate requests to identify whether certain groups of tier 2 ICT migrants are being paid less than the national minimum wage.

If you will not reconsider your decision then please may I request a internal review of the decision to deny my request based on section 14 (2).

Yours sincerely,

Gary Burgess
