SNDC Planning

Waiting for an internal review by South Norfolk District Council of their handling of this request.

Dear Sir or Madam,

Please identify the number of meetings that staff and political representatives of the SNDC have held with the occupiers of Kingsland House over the last six years.

Please identify the costs associated with these meetings to the Council, and if the meetings were of a formal or social nature.

Yours faithfully,

C. P. ELLIOTT

Right2Know,

Dear Mr Elliott

Thank you for your request which is being considered. You may be aware that we have 20 working days in which to respond to FOI requests and you will therefore hear from me again by 14 November 2008 or earlier if possible.

For your information, the Act defines a number of exemptions, which may prevent release of the information you have requested. There will be an assessment and if any of the exemption categories apply then some or all of the information may not be released. You will be informed if this is the case, including your rights of appeal.

There may be a fee payable for ‘reasonable disbursement’ costs such as postage and photocopying. This will be considered and you will be informed if a fee is payable. In this event the fee must be paid before the information is processed and released. The 20 working day time limit for responses is suspended until receipt of the payment.

If you have any queries or concerns then please let me know. If you do contact us again concerning this request, please quote FOI 08-173.

Dear Right2Know,

I understand the property has billing authority reference 0300601310.

It is further understood that the Solicitor to the Council has validated the identity of the occupants. You could start there..

Yours sincerely,

C. P. ELLIOTT

Right2Know,

Dear Mr Elliott

My duties under the Freedom of Information Act are to provide recorded information. In order for me to do so, I do need to know what information you are actually requesting. Please let me know who the occupants of Kingsland House are, which officers may have had meetings with them and any other information such as possible dates of meetings.

Without further clarification, I am unable to assist.

Dear Right2Know,

I have some knowledge of dates of meetings (i.e. 01 September 2007 - Head of Paid Service). However, I am unsure of all other dates. I am aware that several members of the Planning and Legal Staff of the Council seem to have very regular meetings with the occupiers.

I think an internal review is required as the Council is responsible for its own records and if these are not accessible then it makes life very difficult.

Yours sincerely,

C. P. ELLIOTT

Right2Know,

Dear Mr Elliott

Please can I request you again, to use the unique identifier attached to
each FOI request as otherwise, confusion can arise as to which request you
are referring to.

Turning to your request for an internal review, it appears you have
misunderstood the purpose of an internal review. It may assist if I
explain what the purpose and reasons for internal reviews are.

When a request for recorded information is refused using an exemption as
laid out in the Freedom of Information Act 2000, then the requester has
the right of appeal against that decision. The first stage of that appeal
process is to request that the public body refusing the information
convenes an independent panel to examine the decision and the reasons
behind it. They will then either uphold the decision and refuse to supply
the information, or overturn the decision and release the information. If
the first course is followed and the information is still not released,
then the requester may appeal to the Information Commissioner.

Under the request for information which has been given the identifier FOI
08-173, I have requested more information to enable me to commence
searching for the information. I have therefore not refused to supply any
information to you and thus it is not possible for a internal review to be
convened to examine the refusal, as there has been no refusal. No action
will therefore be taken on your email until I receive further
clarification as requested. Just the name "Kingsland House" is
insufficient to enable me to locate any information around meetings.

Should you wish to take this matter further, you will need to contact the
Information Commissioner whose details are as follows:

Office of the Information Commissioner
Wycliffe House
Water Lane

You might want to point the public authority in the direction of the Secretary of State's Section 45 Code of Practice on dealing with dissatisfied FOI requesters, see my annotations here: http://www.whatdotheyknow.com/request/mo...

A "response" to a request for information applies to any communications from the public authority relating to the request, so could include the "technical" aspects to request handling.
