Dear Health and Safety Executive,

Please treat the following question as a Freedom of Information request. I would like any response to be made electronically wherever possible. Please do not treat this request as a repeat request.

This request is to for you to release the full reports listed below:

1. Examination of the control system of the Smiler roller-coaster at Alton Towers
following a collision between trains – HSL Report number MH/15/190;
2. Report on the mechanical investigation into the Alton Towers Smiler ride
incident – HSL Report number ES/2015/70;
3. Smiler Investigation report – Inspection report of 450 meter track section –
external report commissioned by HSE.

If these can not be disclosed can you please advise exactly how you weighed public interest against the commercial sensitivity for each of the three reports? Can you also confirm who would be prejudiced by releasing this information and have you consulted with them?

I am also asking you to release all parts of the reports that is not deemed commercially sensitive

Thank you for your request for information which was received on 17^th
February 2017 I can confirm that the Health & Safety Executive does hold
the information you are seeking.


The FOI Act obliges us to respond to requests promptly, and in any case no
later than 20 working days after receipt of a request. However, I am
writing to advise you that the following exemptions apply to the
information you have requested:-


Section 43 – Commercial Interests


This is a qualified exemption and is subject to the public interest test.

Where we have to consider the balance of the public interest in relation
to a request, section 10(3) of the FOI Act enables us to extend the time
for a response by a reasonable period.


In your case we need to extend our response time by 15 working days while
we consult with the parties involved on disclosure of the information and
to give us time to assess whether the public interest in withholding the
information outweighs the public interest in disclosing it.


We therefore hope to let you have a response by 7^th April. If there’s a
need for any further delay we will keep you informed.  I would like to
apologise for any inconvenience caused. 


If you are unhappy with the outcome of your request you may ask for an
internal review. If you are still not content following this you may apply
