Health and Safety Executive

Hi Mr Bayliss

With regards to your request, as I’m sure you can appreciate, there is a
large volume of information to be considered. Can I ask, are you purely
interested in the causation of the incident? If so, this will help
considerably as some of the information we hold does not fall into that
category.

Please reply to me on my e mail address

Regards

Marcia

Dear Mr Bayliss

Freedom of Information Request Reference No: 201611151

Thank you for your request for information which was received on 8^th
November 2016 I can confirm that the Health & Safety Executive does hold
the information you are seeking.

The FOI Act obliges us to respond to requests promptly, and in any case no
later than 20 working days after receipt of a request. However, I am
writing to advise you that the following exemptions apply to the
information you have requested:-

Section 40 – Personal information

Section 41 – Information provided in confidence

Section 43 - Commercial Interests

Section 43 is an absolute exemption and is subject to the public interest
test.

Where we have to consider the balance of the public interest in relation
to a request, section 10(3) of the FOI Act enables us to extend the time
for a response by a reasonable period.

In your case we need to extend our response time by 12 working days to
give us time to assess whether the public interest in withholding the
information outweighs the public interest in disclosing it

We therefore hope to let you have a response by 22^nd December. If there’s
a need for any further delay we will keep you informed.  I would like to
apologise for any inconvenience caused.

If you are unhappy with the outcome of your request you may ask for an
internal review. If you are still not content following this you may apply
directly to the Information Commissioner for a decision.  The Information
Commissioner can be contacted at:
