Freedom of Information Act 2000 – Information Request

 

Thank you for your request for information dated and received on 24 July
2013. The request has now been considered.

 

You asked:

 

Please provide a complete list of companies and name and addresses
including property description of those whose rateable values qualify for
small business rate relief upto £11k but are NOT actually in receipt of it
for whatever reason.

 

Please also include the date that they are liable from.

 

Please indicate if the account is live or not and please supply on an
Excel spreadsheet.

 

Please see the attached document which shows all the accounts with a
rateable value below £11,000 a year and who are not showing as in receipt
of small business rate relief.

 

Please note that we have redacted any accounts where the liable party is
an individual under Section 40 (2) and (3) of the Freedom of Information
Act. This provides an exemption on disclosure where disclosure is likely
to breach any of the principles of the Data Protection Act (DPA). The
information in question relates to an identifiable individual and
therefore meets the definition of Personal Information in the DPA. We do
not feel that the individuals in question would expect their information
to be disclosed in this way and therefore it is possible that disclosure
would breach the first principle of the Act which requires that any
processing is fair on the individual concerned. As a result we feel that
the exemption provided by Section 40 (2) and (3) of the Freedom of
Information Act is engaged.

 

You also asked for the start date for liability. We hold this information,
however, we feel that the time taken to locate, extract and retrieve the
information requested would exceed the appropriate limit as set by Section
12 of the Freedom of Information Act. This is currently set at £450 of 18
hours work at £25 an hour. To go through all 944 accounts, at say three
minutes an account would take around 47 hours work. We are therefore not
obliged to provide you with this information. We may be able to provide
you with details of particular account if you are interested in them.
Please do not hesitate to contact me if this is so.

 

I hope this satisfies your enquiry, however if you are dissatisfied with
the information provided please contact the Information and Records
Officer within two months of receipt of this letter at Allerdale Borough

Dear Gilbert, Andrew,

Thank you for this, what is missing though is non LTD company data, please note I am not looking for any personal information but commercial addresses which can be viewed on the valuation office website and therefore this information is not exempt.

I am just looking for the commercial property address not personal/individual name and therefore this information is not exempt
