Dear Social Care Institute for Excellence,

According to your website the SCIE is involved in:
• identifying and sharing knowledge about what works and what’s new
• supporting people who plan, commission, deliver and use services to put that knowledge into practice

You may or may not be aware that there is a prevalent practice of failure to pay NMW to care staff, which inevitably has a knock-on effect on the standards of care provided. Many commissioners contractually require their providers to pay NMW and even make statements clarifying their understanding of the circumstances in which workers are eligible for NMW. Despite this, their contracted providers continue to fail to pay NMW.

I would like to request any information you hold relating to:

1. The advice that you give to commissioners about whether and how they should enforce contractual obligations

2. Any communications that you have had with other public bodies relating to the underpayment of NMW for care workers, especially in regard to sleep-in work

3. Any policies and procedures which you have relating to the payment of care workers
