responding to you. Specifically, you have requested the following
information:
“I would like a copy of the service level agreement between Croydon
Borough Council and Pegasus Academy Trust relating to the partnership
between Thornton Heath Nursery School and Pegasus Academy Trust.
Please find the requested information attached. Some of the information
within this document has been redacted. We apply Section 41 of the
Freedom of Information Act 2000, ’Information provided in confidence’, to
this part your request.
Section 41 states:
(1) Information is exempt information if-
(a) It was obtained by the public authority from any other person
(including another public
authority), and
(b) The disclosure of the information to the public (otherwise that under
this Act) by the public authority holding it would constitute a breach of
confidence actionable by that or any other person.
(2) The duty to confirm or deny does not arise if, or to the extent that,
the confirmation or
denial that would have to be given to comply with section 1(1)(a) would
(apart from this
Act) constitute an actionable breach of confidence.
This acts as an exemption notice to the redacted information. We have
applied this exemption because the requested information relates to that
which was provided by third parties and in confidence, to Croydon Council.
