Thank you for your email received by Transport for London (TfL) on 6
November 2012 asking for information regarding the proposed Silvertown
Tunnel.
Your request has been considered under the requirements of the
Environmental Information Regulations 2004 (EIR) and TfL’s information
access policy. I can confirm that TfL does hold the information you
require. You asked for:
The results of the analysis conducted of the impact of the proposed
Silvertown Tunnel on traffic in the surrounding area.
TfL is not obliged to supply this information as it is subject to a
statutory exception to the right of access to information under Regulation
12(4)(d), as the request relates to material which is still in the course
of completion, to unfinished documents or to incomplete data.
I can advise that preliminary analysis of the impact is ongoing and the
results are still being collated and validated to ensure accuracy.
Disclosure at this time would be misleading and the release of incomplete
information would be detrimental to any future decision making. TfL plan
to release the analysis in time to inform future consultations which are
currently proposed for late 2013.
The use of this exception is subject to an assessment of the public
interest in relation to the disclosure of the information concerned. TfL
recognises the need for openness and transparency by public authorities,
but in this instance releasing the documents prior to their being
published in the public domain may mean that incorrect information would
be disclosed. Disclosure of this information would not inform the decision
making process and would be likely to lead to inaccurate or misleading
conclusions.
However, at this time. I am able to provide you with a copy of the
‘Assessment of Needs Report’, a copy is attached. I hope you will find
this of interest.
