Thank you very much for your response. Unfortunately, the information you provided does not answer my question but merely gives the adopted policy of SCYYP for dealing with individual cases of sickness.

I recognise that my supplementary request asking to be provided with details of any remedial actions taken by the Commissioner to reduce the upward trend in average sickness may not have been absolutely clear. As I indicated when making that supplementary request, there has been an almost four-fold increase in the sickness rate between 2008 (1.67 days per person) and the first four months of 2010 (6.28 days per person), and my query is related to what specific actions (other than conforming with the adopted sickness policy) are being taken by the Commissioner to address this dramatic increase in absence. Provision of the sickness policy does not answer that query.

Therefore, may I clarify that request and ask that you provide me with the following:

1) Any internal correspondence between the Commissioner and the Chief Officer relating to the increased levels of sickness in the office and seeking to identify potential courses of action to address the problem; and

2) Any external correspondence between the Commissioner or the Chief Officer and any specialist Occupational Health Advisor, seeking advice on how best to address the problem.

Please note that no information relating to individual cases is sought.

I am writing to request an internal review of Scotland's Commissioner for Children and Young People's handling of my FOI request 'Sickness Absence'.

You have acknowledged that correspondence dated 29th April and 4th May 2010 exists between the Chief Officer and the SPCB (Scottish Parliamentary Corporate Body) regarding contact details of the occupational service the Scottish Parliament use for employees. However, you consider this to be exempt as it constitutes personal data, the disclosure of which would contravene section 10 of the Data Protection Act 1998.

It is difficult to see how the full contents of the correspondence would qualify for exemption on data protection grounds. Please therefore supply me with copies of that correspondence with any personal information redacted. In other words, please provide copies of letters from SCCYP to the SPCB with any references to individual employees of SCCYP (including references to ailments) redacted and, also, please provide the replies from the SPCB to SCCYP with that - and any other personal information - redacted.

Also, I note that in the final e-mail of the sequence, Chris Ratcliffe states "I will speak to Tam further before contacting Gail". Can you please confirm if contact has been made with Gail and, if so, please provide copies of any correspondence between SCCYP and her, redacted as necessary to protect the privacy of any individuals.

The correspondence that has been released appears to confirm that the Commissioner has not taken any action to address the general point that the average level of sickness has increased from 1.67 days per employee in the calendar year prior to his appointment to over 6 days per person in the period January to June 2010 !!
