Shropshire Council's use of consultants RSK ADAS (and its predecessor companies)

Dear Shropshire Council,

I am writing to you under the Freedom of Information Act 2000 and Environmental Information Regulations 2004. 

1. For the whole period that Shropshire Council (SC) has retained and/or used RSK ADAS (and its predecessor companies) to provide consultancy services on planning applications in Shropshire, please provide the following:

1.1 The total number of planning applications that SC commissioned RSK ADAS (and its predecessor companies) to provide consultancy services on.

1.2 The total number of planning applications (given in point 1.1) that were granted planning permission by SC.

1.3 A copy of all original documentation authorising RSK ADAS (and its predecessor companies) to be retained by SC.

1.4 The date when SC first retained RSK ADAS (and its predecessor companies).


1.5 Name and position of the SC officer who first authorised RSK ADAS (and its predecessor companies) to be retained by SC.

1.6 The total amount SC has paid, or committed to pay, RSK ADAS (and its predecessor companies) for providing consultancy services.


2. Furthermore, in relation to planning application 17/01033/EIA for a proposed intensive poultry unit (IPU) at Footbridge Farm, please provide the following:

2.1 A copy of all documentation authorising RSK ADAS (and its predecessor companies) to provide consultancy services on planning application 17/01033/EIA.


2.2 Name and position of the SC officer who authorised RSK ADAS (and its predecessor companies) to provide consultancy services on planning application 17/01033/EIA.


2.3 Dates of each occasion SC required RSK ADAS (and its predecessor companies) to provide consultancy services on planning application 17/01033/EIA.


2.4 A copy of all documentation requiring RSK ADAS (and its predecessor companies) to provide consultancy services on planning application 17/01033/EIA.


2.5 Name and position of the SC officer(s) who required RSK ADAS (and its predecessor companies) to provide consultancy services on planning application 17/01033/EIA.

2.6 The total amount SC has paid, or committed to pay, RSK ADAS (and its predecessor companies) for providing consultancy services on planning application 17/01033/EIA.

The Council has been facing unprecedented challenges this year. Firstly,
in response to the flooding in February and now in responding to the
coronavirus (COVID-19) pandemic. During this time, resources may have to
be diverted away from usual compliance or information rights work. The
council acknowledges that it can’t extend statutory timescales of requests
and everyone is doing their best to meet these. However, priority may have
to be given to other areas, eg the safeguarding of vulnerable people,
during this extraordinary period.

Dear Tom Mullen,

On 22 December 2020, in response to an FOI request, Shropshire Council’s Director of Place, Mark Barrow, stated that this was the first and only planning application RSK ADAS the Council had commission them to work on, and that they were not retained and only used when required. Mr Barrow further confirmed that the Council required RSK ADAS to provide consultancy services on this planning application in “September 2020” and that the “Consultancy work [was] requested via a purchase order and verbal discussions with the case officer.”

On 23 December 2020, I requested Shropshire Council please provide the following information: “All correspondence, including, but not restricted to, emails, letters, telephone attendance notes, meeting notes/minutes, invoices and purchase orders between Shropshire Council and RSK ADAS, including any subsidiaries or organisation/business/persons connected with any RSK ADAS company or business.”

On 31 March 2021, Shropshire Council provided an invoice (No. SI69175251) from RSK ADAS and a purchase order (No: 20041602) from the Council naming RSK ADAS as a supplier of Consultancy Services on this Footbridge Farm planning application.

The Council’s purchase order is dated 8th October 2020, and the tax-point of the RSK ADAS invoice is dated 30 September 2020 with a payment due date of 30 October 2020 for an amount of £1,980.

Shropshire Council’s planning register evidences that the Council commissioned RSK ADAS to produce two reports; a review dated 19 August 2020 of the applicant’s odour assessment, and a review dated 15 September 2020 of the applicant’s ammonia assessment. Both reports were lodged on the Council’s planning register on 25 September 2020, and in both reports RSK ADAS thank Mr Hall, the planning case officer for this Footbridge Farm planning application, for his instructions to carry out this work.

Both RSK ADAS reports pre-date the Council’s purchase order.

The Council’s planning register further evidences that RSK ADAS had already worked with the applicant on this planning application well BEFORE the Council commissioned them to work with the Council on this same application.

Given RSK ADAS were a new supplier, it was the first time Council had used them, and the purchase order is dated after the invoice tax-point well after the planning case officer’s instructions to RSK ADAS to carry this work, then please can Shropshire Council now provide all documentation relating to the Council’s original decision to commission this work from RSK ADAS as previously requested on 23 December 2020.
