Dear Sir or Madam,

1. Please tell me how much funding your local authority received in 2008-09 and in 2009-10 from the Scottish Government towards meeting its policy of providing an additional 10,000 weeks of respite care/short breaks across Scotland by 2011. Please tell me how you’re your local authority will receive in 2010-11 towards meeting this policy.

Please tell me how much of that allocation your local authority spent, is spending and intends to spend on providing additional hours and nights of respite care/short breaks in 2008-09, 2009-10 and 2010 -11.

2. Please tell me how much funding your local authority allocated from within existing GAE monies for the purpose of providing hours and nights of respite care/short breaks in 2007–08, 2008-09 and 2009-10 and how much it intends to allocate from within existing GAE monies in 2010-11.

Please tell me how much your local authority spent, is spending and intends to spend from within existing GAE monies for the purpose of providing hours and nights of respite care/short breaks in 2007-08, 2008-09, 2009-10 and 2010-11.

Please tell me to which budget head and purpose your local authority allocated the additional monies it received from the Scottish Government towards meeting the policy of providing 10,000 weeks of respite care/short breaks by 2011 in 2008-09 and 2009-10. Please also tell me to which budget head and purpose your local authority intends to allocate its share of the additional funding in 2010-11.

Please tell me, In relation to your local authority’s commitment to achieving an additional 10,000 weeks of respite care/short breaks provision across Scotland by 2011, how many of these hours and nights have been and are being provided for disabled children and young people in 2008-09 and in 2009-10? Please also tell me how many hours and nights of respite care/short breaks were provided by your local authority for disabled children and young people in 2007-08. Please also tell me how many hours and nights you intend to provide in 2010-11.

5. Please tell me how much money has been and is being spent on providing respite care/short breaks for disabled children and young people in your area in 2007-08, 2008-09 and in 2009-10. Please also tell me what you intend to spend on respite care/short breaks for disabled children and young people in your local authority in 2010-11.

Request for Information

I refer again to your e-mail dated 27 November 2009 seeking information relating to funding for short breaks/ respite care provision.

In the first instance, I should acknowledge that this response falls outwith the statutory deadline outlined in the Freedom of Information legislation - and for this I apologise.

Returning to your request and having investigated, my response to your questions (1) to (5) is as follows:-

(1)/(3) No specific additional resources for this purpose have been received. However, I am advised that this authority has an aspiration to fulfil commitments set out in the Concordat to provide additional support to carers.

(2) There are budgets for residential respite care, and these comprise a sub set of overall respite provision. Most respite, in keeping with Scottish Government guidance is provided on a non-residential basis. All other elements are not discretely identified in separate budget headings, and the information below, although of limited value, is provided in order to be of some assistance.

2007/08 - £2.4m
2008/09 - £2.6m
2009/10 - £2.6m

Budgets for the financial year 2010/11 will be considered and agreed at the earliest in February.

(4) Accurate recording of respite presents difficulties of definition and interpretation, and generally represent an understatement of actual provision. However, indicative figures would be as follows:-

2008/09

Total Respite Nights (Children) - 2,119
Total Respite Hours (Children) - 9,511

2007/08

Total Respite Nights (Children) - 2,397
Total Respite Hours (Children) - 11,745

I regret to advise you that figures for 2009/10 will not be compiled until later this year, and figures for 2010/11 are not known.

(5) As in paragraph (2) above, the following indicative expenditure on this category of respite care is a sub set of overall respite care, and is subject to the same qualifications identified in that paragraph:-

2007/08 - £467,000
2008/09 - £563,000
2009/10 - £567,000

I can further add that the supporting information you seek is already in the public domain on the Council's MARS (Minutes, Agendas and Reports System), and Section 25 of the Freedom of Information (Scotland) Act provides an absolute exemption for information which is already accessible inasmuch as it can be reasonably obtained by other means.

Otherwise, the documents can be viewed at the Council Offices, 166 Park Street, Motherwell or in any library throughout North Lanarkshire. The Council makes a charge of 32p per sheet for the provision of identified reports on the MARS system.

I can advise that North Lanarkshire Council, having regard to the provisions of Section 21 of the Freedom of Information (Scotland) Act 2002, has established a procedure whereby any person who has requested information and is in any way dissatisfied with the decision on that request, can require a review of that decision by writing to the Executive Director of Corporate Services, Civic Centre, Windmillhill Street, Motherwell ML1 1AB. Accordingly, if you are dissatisfied with this decision and seek such review please write to the Executive Director of Corporate Services.

I would advise, also, that in terms of Section 47 of the Act a person who is dissatisfied with a notice given by the local authority under Section 21 of the Act - ie. a notice following a review of a decision by a local authority, or by the failure of a local authority to give such a notice - may make application to the Scottish Information Commissioner for a decision as to whether, in any respect specified in that application, the request for information to which the requirement relates has been dealt with in accordance with the Act. Such an application must be in writing or in another form which, by reason of it having some permanency is capable of being used for subsequent reference - for example a recording made in audio or video tape - must state the name of the applicant and an address for correspondence and must specify the request for information to which the requirement for review relates, the matter which gave rise to the applicant's dissatisfaction with the original decision of the local authority and the matter which gives rise to the applicant's dissatisfaction with the decision on review by the local authority or the failure of the local authority to issue such a decision.
