Freedom of Information request received 15 February 2023

Acknowledgement of request sent to you

Thank you for submitting a request for information. Your reference number
is 18747269.
On 16 March 2023, the Council received an email from you

Dear Adur District Council,
My request for information has been delayed and by law you should respond
promptly by 15 March 2023, I hope this is not a delaying tactic.

16 March 2023, the Council replied to say

Thank you for your email, we apologise that your reply has been delayed. 

A reminder has been sent to the service today on your behalf and your
dissatisfaction is noted and therefore this case has been forwarded to the
Councils' Data Protection Officer for an internal review to be considered.

Request for internal review

The Information Governance Team notified the Data Protection Officer of
your dissatisfaction due to the FOI request being delayed and not answered
within the statutory time frame of 20 working days. I agreed to carry out
a review for you.

Reply sent to you on 30 March 2023

The late reply was sent enclosing a redacted job description of a
sheltered housing officer

Internal review

The review has been carried out by myself, I am Senior Information
Governance Officer and Data Protection Officer and I report to the Head of
Legal Services/Monitoring Officer on behalf of the Councils.

I have not been involved with this request and therefore my view is
impartial. This matter has escalated to an Internal Review since your
dissatisfaction is noted and you are entitled to exercise your right to
request an internal review. You are entitled to tell us if you believe
that something has been missed. 

I have spoken to Officers that dealt with this case and the matter was
delayed internally due to a clerical error. I have reminded Officers of
their obligations under the Freedom of Information Act 2000 and the
statutory deadline of 20 working days following the date of receipt of a
request.  (Section 10 (1)  Freedom of Information Act 2000).

Conclusion

Based on the above facts, this internal review is upheld.
