Dear Homes and Communities Agency,
In March/April 2017 as part of the cutbacks Lancashire County Council is proposing to stop funding support (Supporting People Grant) for sheltered accommodation. This funding covers Scheme based staff and emergency alarm services and as such no staff will be employed on site, or at best they would attend for a matter of hours each weekday for housing management reasons only.

1) With regard to the Court of Appeal case below and with reference to your own guidelines/policies etc.. what restrictions are imposed by HCA on social landlords not to use the misleading term "sheltered accommodation" when there are no other staff on hand?

2) Still with reference to your guidelines/policies, given that no cover is provided at weekends/bank holidays etc..how many hours per day are considered reasonable for other staff to be available to "give a hand" if required, in order to for the premises still to be called "sheltered accommodation" and not to provide a misleading description?

3) Whilst the term “sheltered accommodation” is highly variable in practice, could you provide the characteristics of the accommodation by which the HCA defines sheltered accommodation. e.g. it should be offered primarily to those with some special housing needs; that some communal accommodation or facilities are provided; or that a warden/manager is employed; etc..

"Sheltered accommodation" clearly means something more than ordinary accommodation or shelter, ….....
33. If, for reasons relating to the nature of claimant's vulnerability, there are resident or other staff on hand, then I see no reason why, as part of the definition, there has to be a warden/manager and/or an alarm system.
