2. What is the usual procedure regarding the passing of information regarding students to the police, including what information is required from the police before students details are passed on. Please include any policies, guidance documents or similar information relating to this request.

3. Please provide a breakdown of the type of offence which subjects have been suspected of and the number in each category, which has led to their details being released.

Dear Mr. Franklin,

 

Thank you for your email of 1^st April 2014 requesting information about
sharing information with the Police.  I am pleased to enclose the
requested information set out below:  

 

For all of these requests I am asking for information from the last 3
years of your records.

 

1. How many students details have you passed on to the police.

 

There have been twenty one requests passed on to the police in the last
three years for the release of personal data.

 

a) In how many, if any, of these cases has the University required a court
order before releasing the detail?

None

 

2. What is the usual procedure regarding the passing of information
regarding students to the police, including what information is required
from the police before students details are passed on. Please include any
policies, guidance documents or similar information relating to this
request.

All requests from the Police are asked to provide a form making a formal
request under section 29 of the Data Protection Act 1998.

 

3. Please provide a breakdown of the type of offence which subjects have
been suspected of and the number in each category, which has led to their
details being released.
Although the University does hold the information requested it will not
supply it because this information is exempt under Section 40 (Personal
Information) of the Freedom of Information Act 2005 (FOIA) and is
therefore being withheld.

 

Section 40 confirms that a request for personal information about other
individuals is exempt from disclosure if it does not comply with the
principles set out in the Data Protection Act 1998.  Personal data is
defined as data relating to a living individual who can be identified from
those data and includes any expression of opinion about the individual and
any indication of the intentions of the data controller or any other
person in respect of the individual.  In this instance the University is
the data controller and it has a legal obligation to protect the personal
data of the individuals you refer to. The information is therefore exempt
from disclosure.

 

If you are not satisfied with the University’s response to your request,
you may ask the University to review it.  If you wish to do this, please
write to Mr Michael Thorne, Senior University Solicitor, Legal, Risk &

request and explaining your complaint.  Please include an address for
