Shared costs of planning applications dm/17/3519 and dm/18/3525

The request was refused by Mid Sussex District Council.

Pot Common Protection Association

Dear Mid Sussex District Council,

With regard to the land to the south east of the junction of Old Hollow and Copthorne Road, Copthorne, West Sussex locally known as Pot Common and the above applications, could you confirm that the joint applicant Layla Heal (aka Le May) will be sharing the associated costs involved with them and if so what her percentage share will be?

Could you also explain how the costs for common works, such as ground and weed clearance, drainage, visibility splays and the footpath etc be shared if the application is successful?

Yours faithfully,

Pot Common Protection Association

Dear Sir/Madam,

Thank you for your request. Please find our response below.

If for whatever reason you are unhappy with our response you are entitled to pursue any dissatisfaction, in the first instance, by contacting Tom Clark, Solicitor to the Council, Mid Sussex District Council, Oaklands, Oaklands Road, Haywards Heath, West Sussex, RH16 1SS, email: [email address], quoting your Reference Number.

- Under the FOI the council is entitled to apply an exemption if it believes one exists. In this particular case we believe that Section 43 - Commercial interests applies. This exemption is subject to the public interest test. The contract is a conditional contract and the contract remains conditional and therefore commercially sensitive. The publication of the contract at this stage is likely to prejudice the achievement of the pre-conditions to the detriment of both parties to the contract. This detriment outweighs the public interest in a land contract that could lead to the provision of permanent traveller pitches at this stage.

Could you also explain how the costs for common works, such as ground and weed clearance, drainage, visibility splays and the footpath etc be shared if the application is successful? - As above

If you still remain dissatisfied with the response you can complain to the Information Commissioner - details available at: https://ico.org.uk/concerns/.
