Dear Isle of Wight Council,

Please would you let me have details of the areas in the Isle of Wight that are covered by a Designated Public Place Order (DPPO) AS A DATASET in the form of machine readable boundary line data files using a common data format such ESRI shapefile (.shp) or geojson.

Your request was received by the Isle of Wight Council on the above date
and is currently being considered.

 

As required by the Freedom of Information Act 2000, the Isle of Wight
Council will respond to you as soon as possible and no later than 20
working days after the receipt of your request.

 

Under the Act, there is a limit for responding to requests where they
exceed the Appropriate Fee Limit as set out in the Freedom of Information
and Data Protection (Appropriate Limit and Fees) Regulation 2004. The fee
limit is set down by the Lord Chancellor and is £450 which equates to a
maximum of 18 hours of search and retrieval time. 

 

Should your request fall into this category, we will notify you as soon as
possible, to discuss any options available to you.

 

If you have any complaints in respect of your information request, please
write to the Corporate Information Unit, County Hall, Newport, Isle of

Dear Shane,

Thanks for you prompt reply and the provision of the PDF based maps showing the areas covered by the DPPOs for the Isle of Wight.

I note that your response states that: "The Council does hold the information that you have requested but, unfortunately, we are unable to provide it in the format that you require."

Please would you clarify the reasons for not providing the data in the format I require, specifically as a machine readable dataset, (that is, in an electronic form capable of re-use), preferably in a standard format such as ESRI shapefiles or geojson, bearing in mind s. 102 of the Protection of Freedoms Act 2012 , (1) & (2) which amended the Freedom of Information Act 2000 in respect of the supply of datasets as such.

In what system are the boundary lines currently represented and stored?

In what electronic formats capable of reuse would you be able to supply me the information requested (that is, boundary lines for the areas covered by DPPOs on the Isle of Wight)?

Good afternoon Mr Hirst,

 

I have checked with relevant colleagues who have confirmed that the GIS
maps were created for the purpose of producing the PDF Maps of the areas
only.  Once the PDF documents had been created, the GIS data was deleted. 
I can confirm that this data is not held in shape file format, only the
PDF format that has already been provided to you. 

 

The Freedom of Information Act, nor related legislation or Regulations,
require public bodies to create data in response to requests. 
Accordingly, I regret that we are unable to comply with your request to
provide the data in a machine readable dataset, as this data is not held.

 

I trust that this fully explains the situation.

Good Morning, Shane,

Thanks for your responses and trying to chase this down for me. It seems a little odd to me that having got data into a (useful) GIS format that dataset representation should then be deleted. It also strikes me that even if the council finds alternative ways of representing the data more useful to council needs, the work generating the shapefile has essentially gone to waste, and an opportunity was missed to publish the data as open public data in a shapefile format so that third parties could more easily make use of the information.

As far as the council is concerned, what are the items of record that define the areas covered by the DPPOs? Is each one defined by a "Land Designated by Description" statement, eg as appears in notices announcing a DPPO (eg as shown in the IWCP notice copied in http://blog.ouseful.info/2014/04/18/open... )?

Please could you let me have copies of the definitions of the areas defined for each DPPO that act as the matters of record for the council.
