Sexual Violence policies (Students)

We're waiting for C Short to read a recent response and update the status.

Dear Cardiff Metropolitan University,
Under the Freedom of Information Act, please can I make the following request for information, relating to Sexual Violence Policies at your institution. For clarification, Sexual Violence Policies or procedures relate to any official document, policy, procedure or guidance (or otherwise named) relating to students disclosing sexual harassment, assault or violence (or otherwise named).
1. Do you have a Sexual Violence policy or procedure?
2. If not, does sexual harassment or violence fall under any other student related policies (i.e Dignity and Respect, Bullying and Harassment, or Equality and Diversity policies)?
3. If any policy or procedure exists relating to sexual violence or harassment, please can you provide me with a copy of the document, or a link to your website where I can access it myself.
4. When considering disclosures of sexual violence or assault, do you follow a separate formal procedure, other than under your standard Discipline Regulations/processes? If so, please could you outline the procedure.
5. Do you have an informal resolution process prior to any formal investigation processes relating to sexual violence or assault. This could include mediation, no-contact agreements, or any other process which does not result in or result from a formal investigation into the disclosure.
6. If you responded ‘yes’ to question 5, please can you outline any informal procedures you engage with, and send any documents relating to this process.

If you have asked for the response to your request to be presented in an

1.            Do you have a Sexual Violence policy or procedure?

No (please see Question 2).

 

A cross University Group has been formed to consider the University’s
policy and procedures in line with the Report of UUK Taskforce responsible
for “Changing the Culture” [also Pinsent Masons Guidance]. Also, to
consider any future obligations that may arrive from the UUK Advisory
Group on Staff /Student sexual misconduct.

 

2.            If not, does sexual harassment or violence fall under any
other student related policies (i.e. Dignity and Respect, Bullying and
Harassment, or Equality and Diversity policies)?

Allegations of sexual violence are investigated by the University as
potential ‘misconduct’ under the Student Disciplinary Procedure
(attached).

 

Allegations of sexual harassment may be investigated under the Student
Disciplinary Procedure, or the Harassment and Bullying Procedure
(attached).

 

3.            If any policy or procedure exists relating to sexual
violence or harassment, please can you provide me with a copy of the
document, or a link to your website where I can access it myself.

4.            When considering disclosures of sexual violence or assault,
do you follow a separate formal procedure, other than under your standard
Discipline Regulations/processes? If so, please could you outline the
procedure.

5.            Do you have an informal resolution process prior to any
formal investigation processes relating to sexual violence or assault.
This could include mediation, no-contact agreements, or any other process
which does not result in or result from a formal investigation into the
disclosure.

Prior to investigating an allegation it is necessary to consider other
matters such as protection of student /staff welfare. Students made be
referred to Student Services for specific support. Members of Staff may be
referred to HR for support.

 

If an allegation is made between different individuals who are both part
of the University, it may be necessary to impose preventative measures
such as Action Plans / Conditions to attempt to keep both sides as part of
the University. Such measures may remain in place even if formal action
under a University Procedure is not progressed.

 

If these measures are not possible, then the University may consider
suspension.

 

Mediation is possible under the University’s Harassment and Bullying
Procedure and Student Disciplinary Procedure.

 

6.            If you responded ‘yes’ to question 5, please can you outline
any informal procedures you engage with, and send any documents relating
to this process.

If you are unhappy with the way in which your request has been dealt with
or with the outcome of the consideration given to your request, you may
ask for an Internal Review. If you are not content with the outcome of the
Internal Review you have the right to apply directly to the Information
Commissioner for a decision. Our procedure for carrying out Internal
