2) Violence and Gun Crime: Links with Sexual Exploitation, Prostitution and
Drug Markets in South Yorkshire (2006) by Dr Angie Heal

Both are mentioned in the Jay Report .

Freedom of Information Act 2000 – Request for Information 658

 

I refer to your request for information dated 12 September 2014 and your
subsequent email dated 8 December 2014 and apologise for the delay in
responding. However, as previously advised it has been necessary for us to
obtain the views of the author of these reports into their disclosure and
the further enquiries we have made prior to considering releasing the
reports has been a lengthy process. 

 

However I am now able to advise as follows:

 

Under the FOI Act please could you send me:

 

1) Sexual Exploitation, Drug Use and Drug Dealing: Current Situation in
South Yorkshire (2003)  by Dr Angie Heal

 

2) Violence and Gun Crime: Links with Sexual Exploitation, Prostitution
and Drug Markets in South Yorkshire (2006) by Dr Angie Heal

 

Both are mentioned in the Jay Report.

 

I can confirm that Rotherham MBC does hold a copy of the reports at (1)
and (2) above. 

These reports were prepared by South Yorkshire Police and remain their
intellectual property. Due to the highly sensitive nature of this subject
we have asked South Yorkshire Police for their views on disclosure to
enable us to make an informed decision.  We have been advised that
information within the reports will inform and form part of the ongoing
investigations in to Child Sexual Exploitation including the Independent
Police Complaints Commission investigation and any investigations into
historic Child Sexual Exploitation cases.  We have therefore considered
the s31 exemption (Law Enforcement) of the Freedom of Information Act 2000
in respect of these reports. 

  

S31 is a qualified exemption, which means it is subject to the public
interest test whereby the factors for and against disclosure must be
considered.  The following factors have been taken into account.

 

Factors against disclosure

·                The majority of the information within the reports comes
from personnel in public authorities, voluntary agencies and victims
themselves.  It is highly likely many of these people may be spoken to
again in the new investigations and therefore disclosure of these personal
accounts/views would compromise the new ongoing investigations and
enquiries.

 

·                In addition, it is likely the reports are further
informed by intelligence from SYP systems which if disclosed could impact
on ongoing police tactics.  Disclosure would therefore undermine and
prejudice law enforcement methods.

 

·                There is an inherent public interest in upholding law
enforcement.

 

Factors in favour of disclosure

·                The local authority accepts that the reports are of
interest to some members of the public.

 

A release of information via FOI legislation, must be seen to benefit the
community as a whole and it must clearly be shown that the benefits of
such a disclosure at this particular time outweighs the potential harm
that disclosing such information could cause.

 

In view of the above therefore the authority has decided that the reports
are exempt from disclosure at the present time by virtue of s31(1) (a) and
(c) where disclosure would or would be likely to prejudice the purpose of
law enforcement.

 

We understand that South Yorkshire Police are withholding these reports
under the s22 exemption where there is an intention to publish the
information at some future date (whether determined or not).   The
