(5) Provide a screenshot of electronic records system Carenotes where safeguarding entries are made and explain what measures are in place to ensure said notes are sealed.

If the Trust does not seal safeguarding records explain why not.

(6) Confirm if LB Camden have direct access to the safeguarding section of CareNotes. Confirm if any data from this section is automatically sent to LB Camden and by what means.

(7) Explain what formal protocol of support is in place for patient victims of staff to receive rape and sexual assault advocacy /counselling/ trauma therapy/ referral to specialist agencies at the following stages :

Reporting concerns stage
Safeguarding investigation stage
Police investigation stage
ÇPS and prosecution stage
Post trial and sentancing phase
Professional misconduct hearings relating to above

Provide all information given to patient victims re this.

Provide all written protocols, flowcharts and details of referral or self rerral portals to access and said formal support.

If there is NO formal agreed pathway of support for vulnerable patient victims then explain why not.

Many thanks for the FOI request dated 4th August 2019, this has now been
passed to the relevant teams to supply this data within 20 working days.
 
We have been advised that this request will exceed the 18 hours limit and
may incur costs. To avoid this FOI being exempt under section 12, we will
reduce the years to 2014.  At present,  this is when the Trust records
mainly went electronic.

Presumably you have actually kept figures for the years you are choosing not to report back on?

You have Safeguarding Annual reports for those years. That is 10 minutes given ALL you have to do is log on to the archives and click a few times.

There was a requirement to report to NHSE electronically throughout this time. Again, 30 mins max if working very very slowly. 15 mins if the person retrieving is the same person whose job is to submit to NHSE anyway.

You would have to work at a very very slow pace to add this up to 18 hrs total.

An alternative explanation is that the years you don't want to disclose data on have figures and incidents the Trust prefers to hide.

Following your request for information we received in August 2019, Camden
and Islington NHS Foundation Trust are pleased to respond as detailed
below and attached.

(1) Between Jan 1st  2010 and Jan 1st 2019 how many formal safeguarding
reports of sexual violence/ intimidation/ coercion/ threats where raised
by MH Trust staff? 

 

              2014 – Present

 

To collate this data would exceed the 18 hr limit and incur costs,  any
Safeguarding Reports are recorded individually on each Service User’s
medical records (44,000 service users)

 

We record the categories of safeguarding adults as described in the Care
Act and the pan-London procedures.  Whilst there are categories for
Domestic Violence, Sexual Abuse and Sexual Exploitation, Financial.  We
would not record the categories indicated above.

 

 

(2) Provide the breakdown of said incidents as to the following:

Staff on patient incidents

Staff on staff incidents

Patient on staff incidents

Patient on patient incidents

All incidents involving visitors

 

 

The above are incidents and not necessarily Safeguarding, we can attach an
Excel sheet that was issued from another separate FOI  (2019-212) request,
please let us know?

 

 

(3) How  many of the above were reported on Datix?

              

 

 The policy and the training emphasises that each time safeguarding
concern is raised with the Trust a Datix should also be submitted 

 

 

(4) How many of the above were reported to LB Camden and through which
mechanism? Provide details of any known reported issues in failure to
communicate safeguarding concerns to local authorities and when first
known about.

 

All safeguarding concerns are logged either with Islington’s LAS
electronic patient record or with Camden’s Mosaic electronic patient
record as part of the Section 75 agreement.

We do not have full  access to either Mosaic or LAS it is believed the
Local Authorities have full access and would be able to supply this data.

 

(5) Provide a screenshot of electronic records system Carenotes where
safeguarding entries are made and explain what measures are in place to
ensure said notes are sealed.

As part of the current Section  75 partnership arrangements Mosaic and LAS
are the primary platforms for the safeguarding workflow. 

 

All safeguarding activity is recorded on Mosaic or LAS (apart from those
concerns raised in Kingston).  If we need a particular report then we need
to request this from our borough partners.  The statutory quarterly and
annual reports made to NHS Digital, known as the SAC (Safeguarding Adults
Collection) are made by our borough partners from activity recorded on
Mosaic and LAS. 

 

As a Trust we advise our staff to keep a record of safeguarding in the
Progress Notes of Carenotes and to upload relevant documents into the
Documents facility.

 

If the Trust does not seal safeguarding records explain why not.

 

The primary platforms for the recording of safeguarding adults is either
Mosaic or LAS and not Carenotes.  We are unsure  sure what ‘sealing
safeguarding records’ refers to?

 

If staff accused of sexual assault by patients can access safeguarding
records explain why.

 

If allegations of a safeguarding nature are made against a member of Trust
staff it would be very unlikely that such a member of staff would be able
to access the safeguarding record as the safeguarding workflow is held on
Mosaic in Camden, LAS in Islington, and for Kingston then it would be
Kingston’s system.  Only dedicated Trust staff, as part of the Section 75
working arrangements, would have access to Mosaic or LAS. Since it is
possible to audit who has accessed records on CareNotes, unautohrised
access can be detected.

 

No Trust staff have access to Kingston’s  Local Authority electronic
patient record.

 

(6) Confirm if LB Camden have direct access to the safeguarding section of
CareNotes.  Confirm if any data from this section is automatically sent to
LB Camden and by what means.

 

As part of the Section 75 arrangements only specified LB Camden staff will
have access to Carenotes.  These will invariably be MASH (Multi Agency
Safeguarding Hub)  personnel. These are based within local authorities and
can relate to children or adult services or both.  Not all local
authorities have a MASH.   The safeguarding platform is held on Mosaic or
LAS.  Data is not sent to LB Camden - it is directly inputted into Mosaic 
by the staff involved or via the Safeguarding Hub of the Trust,  We have
limited access to Mosaic or LAS.

 

 

(7) Explain what formal protocol of support is in place for patient
victims of staff to receive rape and sexual assault advocacy /counselling/
trauma therapy/ referral to specialist agencies at the following stages :

 

Reporting concerns stage

Safeguarding investigation stage

Police investigation stage

ÇPS and prosecution stage

Post trial and sentencing phase

Professional misconduct hearings relating to above

 

Provide all information given to patient victims re this.

The Trust has a ‘Managing Allegations Made Against Staff Policy’ which
sets out how such allegations need to be investigated.

 

The Trust has a ‘Sexual Violence Policy’ which sets out how victims need
to be protected and safeguarded.

 

The Trust has HR processes for the management of allegations concerning
staff accused of crimes against the person.

 

The Trust has a SI process to investigate concerns.

 

(9) How many staff were reported to the Disclosure and Barring Service (
formally CRB) during the time period in (1)

 

We have been advised that the Trust is currently in the process of
submitting two referrals
