Re: DfI Rivers infrastructure - North Belfast.
Thank you for your email dated 7 April 2021 requesting information regarding DfI
Rivers’ storm drains in North Belfast. We apologise for the significant delay in
providing you with this response.
The information requested falls under the aegis of the Environmental Information
Regulations 2004 (EIR), as opposed to the Freedom of Information Act 2000

In response, the Department does hold information relating to your request.
However, the Department has determined that it should not disclose that
information at this time for the following reasons.
The information you have requested currently forms part of information which is
subject to consideration in relation to ongoing inquiry by the Coroner, in the
context of ongoing legal process (an inquest). The Department is of the view that
disclosure of the information would adversely affect those investigations /
inquiries and, in order to avoid undermining this process, therefore, the
Department considers that the information should not be disclosed, having regard
to the exception provided by EIR Regulation 12(5)(b), as disclosure would
adversely affect the course of justice in relation to those ongoing processes.
The public interest in al owing the Inquest proceedings (or any other proceedings)
to take place without any adverse impact from the Department disclosing
information outweighs the public interest in disclosing the information at this time.
In the event that any of the information held by the Department relating to this
request would not be classified as environmental, the Department would consider
that the exemptions in the FOIA under s31(1) (a), (b) and (c) would apply, as
disclosure would prejudice the purposes listed in the FOIA. In addition, the
exemption under FOIA s31(1)(g) (in relation to the purposes listed under s31(2)

(a), (b), (e) and (j)) would apply. The public interest would remain in favour of not
disclosing information to allow the proceedings to continue without any prejudice.
If you are dissatisfied with the handling of your request, you have the right to ask
for an internal review. Internal review requests should be submitted within two
months of the date of receipt of the response to your original letter and should be
