Sewage pipe under proposed new railway

Dear Thames Water,

On 1 August I sent an email to you using your own intranet message service. I do not have a copy (despite asking for it) but I said, to the effect:

"Chiltern Railways, under the proposal Evergreen-3 (see http://www.chiltern-evergreen3.co.uk/) intends to build a new railway line along the old trackway 14m to the east of the present mainline from Oxford Station to the North Oxford Junction. This junction is 1km north of Aristotle Lane, Oxford. I understand that in the early 1970s the water authority constructed a new sewer (approximately 1.8m diameter at a depth of 7m) along the length of this old trackway. Please may I know:

"a) whether Thames Water knows about this application and
"b) whether it will permit Chiltern Railways to build over the sewer."

On the same day, Justin Hulbert of your company sent this reply:

"Thank you for your email.

"Your query is now under investigation with a dedicated member of Thames Water's Customer Relations team and I would like to make sure that we fully investigate any points or answer any questions you have raised before we reply to you.

This request relates to a proposal of Chiltern Railways to construction a length of new track from Oxford Station northwards to the junction with the Bicester line. It is understood that in the 1970s, the sewage of North Oxford was diverted into a new pipe that runs immediately below the path of the intended new track. This is of environmental concern not only owing to the ability of the pipe to withstand additional loading and vibration, but also with respect to the feasibility of maintaining the sewer once the track has been laid. It is not clear that the sewage utility company is aware of Chiltern's proposal.

Thank you for your emails of 1 and 21 August 2010 regarding the sewage pipe
under the proposed
new railway in Oxford. Please accept my apologies for the delay in our
response.

I have discussed this case with our Developer Services department who are
the first contact for any
buildover requests. They can confirm that at present, we do not hold any
record of a buildover request
for this project. However, without having an idea of who would have
applied, we cannot carry out an
exhaustive search.

Please be aware that if the scheme is still in the consultation stage, we
would not yet have record of a
buildover application. We cannot comment as to whether or not the
application would be accepted
until a request is received.

As requested, please find attached a copy of the two emails we received
from you for your records.

Thank you for your email. Whereas you say you have received no application for a build-over, I would appreciate a response to my second question, namely:

"whether [Thames Water] will permit Chiltern Railways to build over the sewer."

For your urgent information you may not be aware that there is to be a public inquiry in Oxford on 7 November to be held under the Transport and Works Act 1992 concerning "The Chiltern Railways (Bicester to Oxford Improvements) Order". The matter is being co-ordinated by the TWA Orders Unit Zone 1/31, tel 020 7944 2474. Chiltern Railways are to be represented by Eversheds, contact Victoria Rolfe 0845 497 4899.

It is clear that Thames Water (and by inference its customers) have a critical interest in this matter and I am astonished that you have not been notified. I shall inform the inquiry co-ordinator of this.
