Dear Severn Trent Plc,
On 16th February 2022, STW wrote stating that "Monitoring data received by the Environment Agency is environmental information and is normally provided on an annual basis, or at our request. Whilst the investigation is ongoing, it's vital that any potential evidence or proceedings are not compromised by the inappropriate sharing of sensitive data or information that could jeopardise EA's ability to take enforcement action...." Providing the EDM start and stop times would adversely affect the current investigations and any regulatory or court hearings that may result (should there be any); this information is relevant to matters which are subject to potential consideration by the regulators and potentially the courts. In this context, regulation 12(5)(b) provides an exemption from disclosure. STW are satisfied that the public interest in not disclosing the data and not prejudicing the investigation is greater than the public interest in providing the data.

As such, given the ongoing investigation, you said that you were unable to provide EDM start and stop times data for Southwell STW at this current time. Where further data on our treatment works can be shared, similar to the EA, STW will be publishing the data on our website. They say I will appreciate, however, that STW are limited in what we can say during the current investigations.

Many Thanks for your Environmental Information request.
Event Duration Monitoring data is provided to the Environment Agency each
year as part of our regulatory Annual Return, in line with permits issued
under the Environmental Permitting Regulations, specific data relating to
individual spills is not required as part of our data submission. Data
pertaining to our 2022 performance, including data relating to the
Southwell STW has been submitted to the regulator and is now available on
[1]our website. This data covers annual spill data for the reporting
period from 1^st January to the 31^st December 2022.
