I am writing to you in my capacity as Freedom of Information Officer to
advise you that we have the right to withhold any individual’s personal
information being given to a third party under Exemption, Section 40  of
the Freedom of Information Act 2000.  This states that personal
information should not be disclosed if it would contravene one of the
principles of the Data Protection Act.

 

The principle which we believe would be contravened is Principle 2 which
states that Personal Data should be “obtained for specified purposes and
not processed incompatibly with those purposes”.  This exemption is an
absolute exemption under the act.

 

The Council makes every effort to make sure that the services it provides
are as efficient and effective as possible, and this includes any requests
under the Freedom of Information Act.

Thank you for your email. As requested I have revisited this request and am happy to provide the following explanation.

The information previously released, and referred to in your email of 28 June 2018, was disclosed because it required the agreement and approval of full council.

Your query is around payments made to individuals who have resigned over the last two years. Mr Walker did not resign - he was made redundant - a resignation was not given or required.

All payments that have been made to individuals over the last two years are those which the Council have been obligated to make under the terms of their contract or other agreement in place. We are not able to give the amounts or details as the information is considered personal and confidential.

As such we continue to rely upon the section 40 absolute exemption outlined in my original response.

I hope this is the information you require, but do not hesitate to contact me if you wish to clarify anything further.

I am grateful for your reply.

I have been led to believe that payments totalling over £80000 have been made to 2 people who tendered resignations over the last year alone. This seems unusual and I am merely trying to establish if information I have been given is accurate and if it is, why payments have been made in these circumstances. All of this is in the public interest.

Having trawled previous Copeland Council responses, I see that you have disclosed rates paid to certain individuals. May I ask why this information has been disclosed? May I also ask why pay offs to people resigning has not needed full council approval? Spending the public purse in such unusual circumstances seems a more relevant consideration to be put to politicians than Mr Walker's redundancy settlement.

FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST 7490/18

 

Thank you for your request for an internal review of your FOI request
around Severance Payments dated 4 July 2018.  For clarity, your previous
request dated Saturday 29 June received by Mr Walker Monday 2 July, was
under consideration under the terms of the Freedom of Information Act 2000
but unfortunately, he did not have time to respond before you requested a
review.

 

Therefore, I have now reviewed all your requests and my response is as
follows:

 

The Council neither confirms nor denies that it holds the financial
information falling within the description specified in your updated
request of 29 June.  Neither does it dispute that historically the Council
and local media have reported some details of redundancy payments
following discussions at Full Council, such as the release package to Paul
Walker, the former Chief Executive. 

 

There is a requirement for Full Council to approve any severance package
which is more than £100,000, as per the Council’s pay policy which
stipulates as follows:  

Any severance package over £100,000 will be the subject of a report and
approval of Full Council.  This will clearly set out the components of the
package including salary paid in lieu, redundancy compensation, pension
entitlements, holiday pay and bonuses, fees or allowances paid.

 

Any other packages that may or may not have been approved to employees of
the Council have also been agreed as per the Council’s pay policy which
stipulates as follows:

In accordance with the Constitution of the Council, the Executive is
responsible for strategic policy decisions in respect of employment
matters. Decisions in relation to the recruitment, pay, terms and
conditions and severance arrangements of employees of the Council rest
with the Head of Paid Service, except where they relate to Chief Officers
in which case they rest with the Personnel Panel. 

 

Therefore, the outcome of my review is that the Council have the right to
withhold any individual’s personal information being given to a third
party under Exemption Section 40 of the Freedom of Information Act 2000.
 In accordance with the Councils pays policy, only payments above £100,000
require the approval of Full Council and will therefore be reported upon
and details shared.  

 

The Council makes every effort to make sure that the services it provides
are as efficient and effective as possible, and this includes any requests
under the Freedom of Information Act.  Unless you require any further
explanation from me, we will consider the review of your FOI request
closed but if you believe that your request has not been dealt with
satisfactorily, you may refer the matter to the Information Commissioner’s

The Council have the right to withhold any individual’s personal information being given to a third party under Exemption Section 40 of the Freedom of Information Act 2000. Any payments of over £10,000 but below £100,000 would fall under this exemption.

Any payments of over £100,000 require the approval of Full Council and therefore become public information. I can confirm there have not been any such payments in the last 2 years.

Copeland are rumoured have paid large amounts to people who have resigned and as a tax payer I think I have a right to know why. Can Copeland at least confirm that the Property Manager was not paid £45000 when he resigned last year and that the Director of Commercial and Corporate Resources was not paid £40000 when she resigned this year?

I am sincerely sorry Mr Anderson but as previously stated I am afraid the Council cannot comment further to either confirm or deny any payments made under Exemption Section 40 of the Freedom of Information Act 2000.
